WAB: Milky Way Tax Boondoggle

What could have caused all the buzz around Commissioner James Harwell’s house today? Surely it wasn’t Commissioners Reedy and Woodard trying to convince him to sign a request for an emergency meeting of the commissioners so they can vote on giving away the northern end of the county? Of course this could not be true since it would be a direct violation of the state open meetings law. But then why would they be concerned about that when they already had violated it in Mrs. Vanzants office earlier with the same proposal. I commend Mrs. Vanzant for refusing to go along with this expensive request and can only hope the rest of the commissioners are unwilling to have an emergency meeting at county expense and then vote to not put a county property tax on the development at Milky Way. There aren’t enough words in Dennis Miller’s vocabulary to adequately describe this boondoggle. If this special act is accepted a person with an $80,000 house will actually pay more county property taxes than someone on the Milky Way with a million dollar home. With this plan all the benefits go to Milky Way while the county stands holding the bag once more. -- Allen Barrett

You are on target. Only a bunch of idiots would consider passing this legislation. Giles County collects property taxes inside all its cities, as does the city itself. If Milky Way wants to be its own city government, there may not be anything wrong with that, but to exclude Giles County from collecting property taxes on the Milky Way Development is NUTS. If this passes as it is presented the commissioners voting on it need to be recalled.

I was also wondering if you know Dennis Miller personally. It seems you would have to have an immense personal knowledge of him to know so much about his personal activities. I suppose on the other hand you simply treated him the way you do most other people, you just make up something and try to pass it off as fact. WHY cant a bunch of millionaires afford to pay their way instead of riding on the backs of working people ??
They want taxes back to 'develop the community ' -which will have locked gates most of the time so GUESS who will get the benefit ??
If they want their own private amenities (Water from a bigger pipe , sewage down a deeper hole , fire-protection with 30 seconds call-time ...etc etc ..) let them get on and PAY for it with their own $$$ instead of looking for continuous subsidy .......and MORE POWER to them for doing it that way in lieu of whining at Commissioners Courts .

PS I'd LOVE to get MY taxes back so that WE can develop our private community too .Wouldnt you ??

It is obvious that most of you who are posting on this site have no clue as to what is going on or what is being proposed.

what is being proposed is that those who purchase land and build homes in the Milky Way development will pay taxes to the County. A portion of those taxes will go specifically towards development progects that will improve the Milky Way development (as well as the rest of Giles County). The private act states that a percentage of real estate taxes will be set aside of specificate projects, such as an Emergency Services station (fire, rescue,and EMS), fiber optic cable being run to the Milky Way Development as well as the Richland schools, and Lynnville, and public water to the citiznes in the Milky Way area. these improvement wiil NOT BE PAID by any county citizen, unless you own land within the Milky Way development.

GET REAL PEOPLE !!!!!

CanGiles County afford a new water line?

CanGiles County afford to run fiber optic cables to the Richland schools???

Can Giloes County Provide public water taps to citizens along Keer Hill Road????

5-3-7 "Don't take candy from strangers" rings in my ears. The private act proposal is fatally flawed as presented, in Section 12. Is this one of the things that is going to be corrected?

1. "... the District (Milky way), its properties at any time owned by it and the income and revenues therefrom shall be exempt from state, county, and municipal taxation." "Property" eliminates property tax. "Revenues" eliminates all sales taxes, including the local option school sales tax. By definition, sales are revenues.

2. The bond income exemption sounds good, only if applicable to ALL CITIZENS of the county & state.

3. "... bonds issued by the District shall be deemed to be securities issued by a public instrumentality or a political subdivision of the State." Needs a better explanation with specific written financing purposes. No personal property not open to the public. Municipal tax exempt bonds provide an income tax dodge that notably reduces the interest rate. The tax dodge means less tax revenue. Average people must make it up & pay.

This smells like an incentive some politically correct idiot dreamed up. If so, they need to go! If not, the developers must think we are a bunch of illiterate idiots. Chances are pretty high that we are about to engage in a nasty situation that never should have happened. It sounds like time for the County Exec. or a citizen to get another injunction - this time to stop secret meetings. The Sunshine Law has no teeth, but an injunction sure does - including slammer time! Hickory - if you are who I think you are, thanks for your wisdom!!!

To concerned citizen. You asked me to explain how Milky Way is bad for Giles County????? First I never said that Milky Way was bad for Giles County only that the way it is being presented will leave the county in a very bad spot and the citizens holding the bag full of now due notices.
The most important thing to consider at this point is simple. What exactly does the agreement require and allow? This means we must have exactly the same understanding when we read it as do those who wrote it. Very often because many words are inconsistent in their meanings they must be clearly defined in the beginning so that what we thought they meant will become what they actually mean by law. Anonymous of the May 03, 2007 10:01 PM post put their finger on the trigger of the whole agreement by pointing out Section 12 which clearly has the potential of putting the citizens of the county into a very deep, dark hole.
This matter is far too important to be rushed into and certainly should not even be considered until after the lawyers have gone over it with strong magnifying glasses. There should also be a public hearing on a matter of such importance with every question asked and every answer given legally recorded so that there can be no contention later between what was meant and what was written. Tomorrow’s radio program should help some but keep in mind that a radio interview carries very little weight next to a written document. Allen Barrett

Whether you believe this is good or bad, this needs to be researched, documented and thoroughly discussed by the County Commission and taxpayers of this county. I believe the commission needs to hire someone who will present the good and the bad, in dollars and cents, so an informed decision can be made. The "benefits" listed sound really good, but are they? Someone without connections needs to come in and look at this. What will it hurt? The commissioners who have called this special session need to rethink what they are doing. Why is everyone is such a rush? The Hunter-Smith fiasco is a prime example of county leaders who do things without thinking of the consequences of what they were doing and if they call a special session and pass this private act without true knowledge and investigation then they are heading down the same ignorant path.

Another thought:

The developers have waited until the last minute to bring this before the county commission. If it is passes in the Special Called Session, then it will immediately be sent to the State Legislature. The State Legislature will only be in session another couple of weeks.
It is time for our lected body to SLOW DOWN and think. It is not a time to be rushed into passing a piece of legisaltion that has not been thoroughly researched.

Thank goodness for commonsense !! From the comments already here it seems that Giles Citizens are waking up and realising that this series of 'offers' on Milky Way are really quite the opposite from how they read at first glance .
There can be little argument that , if properly done , MW should be of benefit to Giles County BUT it needs to be done WITHOUT concessions (hidden or otherwise ) from local taxpayers .
If the project funding isnt strong enough to support itself then it needs to fold as a dud speculation rather than be floated on the backs of local taxpayers .If the speculators feel a need for supplemental income to support their fancy lifestyle then they need to proscribe same by putting covenants into their deeds UP FRONT so they can all stand in a circle and tax themselves .
Support Milky Way ..yes
Pay for Milky Way ..NO !!
Call ALL your local commissioners and TELL them how YOU who put them in office EXPECT them to vote on May14th ........or that they'll be out of office next time we vote .

This group that represents Milky Way must not read the local papers, blogs etc. These Elected officials cant even do a construction project (Hunter-Smith)correctly, adopt reasonalble budgets or implement the financial management act in a timely manner. Charles Ausburn and Donnie Moore were guests on WKSR’s Bonus Hour this morning. Auburn is the owner of Milky Way Farms and is developing his New Horizons community on the property. Moore is the Sales and Marketing Manager for the development.

They appeared on the radio to answer questions concerning the private act that was presented to the Giles County Budget Committee earlier this week. “There have been many rumors and misconceptions about what we’re asking for,” said Ausburn. We welcome this opportunity and forum to set the record straight.”

One of the main misconceptions has to do with the taxes.

The Milky Way Improvement District, once created would provide for two separate types of financing vehicles — Special Assessments and Tax Increment Financing.

Through Special Assessments the district would have the power to levy tax assessments against property located only within the Milky Way Farms development. These assessments would be paid in addition to property taxes imposed by Giles County. This revenue could be used to pay off bonds or other debt issued by the district, and according to Ausburn, would be primarily used on projects at the development.

Through the TIF mechanism, a portion of the additional tax revenue generated by the increase in property values at the development would be designated for use by the district.

“What we are seeking from the County is 15% of the “additional” revenues that will be brought in over a 20 year period to help with these projects,” said Moore. “Giles County would receive the remaining 85% of the new tax money.”

A section of the private act stated that "In accordance with the provisions of general law, the District, its properties at any time owned by it and the income and revenues therefrom, shall be exempt from State, County and Municipal taxation.

Neither Moore, nor Ausburn addressed the wording of that section on the radio, but did address it with Pulaski Publishing Managing Editor Scott Stewart. Here’s is how Ausburn addressed the wording.

“There is a phrase in the private act that says the district may be exempt from state and local taxes,” says Ausburn. “This in no way means that the property at Milky Way Farms will be exempt from state or local taxes. What it means is that property owned by the governmental entity, the district, could be exempt from state and local taxes. This is much like a municipality that owns property but does not pay taxes on that property. The Milky Way Farms development property will not be exempt from taxes.”

Ausburn was asked about the urgency of bring this before the County Commission and the State Legislature. “The time crunch we are facing is based on when the state legislature closes its current session. It is vital that this act is passed during this session,” says Ausburn. “I didn’t realize that we were facing this deadline until a couple of weeks ago when the attorneys told me we needed to go ahead and start getting something going here that day. That threw me a little curve.

The intention has never been to place any pressure on the county or anyone. However, this is the situation we are faced with, and we are trying to do whatever we can to help move the process along. We are quickly approaching the time when we will start selling lots at Milky Way Farms. When these lots begin to sell the value of all the property begins to rise dramatically. Getting this district created before those property values go up is essential to making this project work.

Anonymous 5-4 1:52 failed to mention that when asked on the radio interview about a public hearing, Asburn stated "he didn't want one before the May 14th vote but a public hearing could be held after it passes the legislature." He must think we are a bunch of dumb butts and it points out they are trying pull a fast one. Who is he to dictate if a public hearing should be held for the people of this county anyway. Is he already so wrapped up with the money folks that he is now directing what the local gov does.

If a computer and a desk are the only assets of "the district", why bother to put section 12 in the private act? Who will own the golf course, pool, and other amenities? What is the asset side of tax exempt "... bonds issued by that district shall be deemed to be securities issued by a public instrumentality or a public subdivision of the state"? Aren't developers equired to provide infrastructure with the homes they build, out of their pocket?

If MW is a separate municipal entity, we sure don't need 6 of our county commissioners trying to run their functions. The MW (local government) should be run by their association or residents, not the county! Doesn't make sense for the MW residents or the county.

MW is potentially a wonderful project that will attract good people. It's easy to eliminate the "confusion" written into section 12. That needs to be done before anything is approved!

our schools.

There is absolutely no way you people will ever be happy.

If the county comission does something you don't like you jump on them.

If the county comission does something you like, they didn't do
enough of it or they didn't do it right.

to screw the people in the county.

Would you buy a house, a car, or even a pair of socks without at least checking it out? Now certainly one would be expected to give more attention to buying a house than a pair of socks but even with socks you check to see what size they are. Rushing into an agreement without understanding it is simply stupid.
The Milky Way project may be the best thing that has happened in Giles County for many years and what I've said along with many others is simply check it out before you buy it. I believe that if section 12, which exempts the project from city, county and state taxes, were removed from the agreement the project would be enthusiastically embraced by most all of Giles County. This section is the major problem and if there is no intention of ever using it why is it included? There’s an old saying about “think before you jump” at this point we’re being asked to jump without thinking asking questions and getting clarification. I would hate to see the county buy another pair of socks that don’t fit. Allen Barrett

Passing a private act written by someone you don't really know, with conditions you don't understand, that clearly says tax exempt status for property, with the issuance of exempt bonds to bring in cash for assets of undefined nature - begs an idiot's signature! Wanting it to pass it without public input or understanding begs an idiot's endorsement with demands to git-R-done. The time lapse "OOPS" is about as credible as "the dog ate my homework"! The secrecy issue is big bright red flag that can easily be put to rest with understandable contract language, now, not after agreement! Running a mouth doesn't fix it!

A food fight helps no one! Anyone can make an "OOPS", misjudgment, or think something right is wrong. Public disclosure is all about discussion, understanding, open changes, and then agreement! Uninformed agreement with potential disinformation is nothing but war! It is a totally unnecessary stupid fight. Give MW all the time they want to explain or whatever, with legal independent representation on both sides - define the undefined & present a true agreement. I'll never use MW, but I hope they succeed & build a show place! I respect their right to privacy and prosperity! I'll fight for those rights - for myself or them!

opportunity?

There is a glass, lots of water to put in it. It simply needs the hands to fill it. If it's sealed, do you know if it's full of water or air, unless you pick it up?

The facts in question, in section 12 plus open communication, were clearly identified, and very easily resolved. There is absolutely no animosity or disrespect intended. If you like Giles county & the beauty we have, there is probably very little difference between us.

If somebody was offering to GIVE me any of those items and what they were giving me looked good enough and smelled good enough then I'd be glad to take them without checking them out.

Nobody's asking anybody to BUY anything.

What if somebody was wanting to give you a house, but they said that circumstances dictate that you go ahead and SAY you want the house so the neighborhood association could look at the deal. But, even if the neighborhood association agrees to the deal you don't have to take the house. You have the right to refuse on the back end. You gonna
turn it down?

Of course, at this point you will go on and on about how it depends
on if the house has termites crawling around in it and can the
neighborhood association tell you where to put your petunias and is
the foundation cracked and does the roof leak and does it have an
adequate water supply and does it have fiber optic cable access and
is there a good EMS station nearby.

The fact is what I said before is true. Happiest when unhappy. You
live to stir things up. Your opening to this thing was as biased as
it could be and you didn't even know the details at that time. At
least I hope you didn't since most of what you put has been shown to
be untrue. You started this off making people think it was a bad idea before anybody had a chance to even see what it was.

That is a shame.

And, I stand by my prediction that should this get defeated, you and
your herd of sheep on here will be baaing to the wind about those
mean old rich people at Milky Way who haven't done one single thing
for the county and the county needs to make sure EVERYBODY has water and access to ambulance and fire services.

And even your negativity wouldn't be so bothersome if it seemed that there was anything that could satisfy you. But it doesn't. Just like I said in my original post, it makes no difference what is done or not done, you are against it. Why?

Maybe that would be a good subject for this blog: Why is it that this

Swami - if you could read & comprehend the words, you might understand the need to know what's happening. If they are tax exempt, there will be NOTHING GIVEN TO GILES COUNTY - NO LOCAL OPTION SALES TAX OR PROPERTY TAX - nothing for schools. If the man says they pay taxes ETC. like any other county resident, put it in the agreement & take the tax exempt thing out!

You stir up the conflict by criticizing anyone who wants any form of recognizable agreement. Have you ever owned a home, bought a car, or taken out a loan? On the other hand we don't know who you are or what your motives are, do we.

You sound more like a lacky political wheeler dealer who has an inside track on grants, gimmies, & the use of someone else's money, not someone from MW. Have you promised them the moon & stars & find yourself putting MW & GC both in a bind?

If they are so careless as to keep track of a simple deadline how many other things have they neglected or have swept under the carpet? Why should'nt everyone be leary? Look at everything else that has been done. You should be asking yourself why does'nt everyone in Giles Co. already have water, why does'nt northern Giles County already have an ambulance service, why does'nt the Bodenham community already have a Rescue Squad? Where is all the money going that's already being raked in?

Not only are you wrong on almost everything you said you have either misunderstood or simply chosen to lie about those things in a very underhanded way.
Let me make this clear although I have already addressed the issue twice before on this thread. I am “FOR” the proposal at Milky Way “except” for section 12. As I said before if there is no intention of ever using Section 12 then obviously there is no need for it. Take Section 12 out of the proposal and you will not only have my full support but also the support of most everyone else who has simply asked for a legal examination of the proposal and the removal of Section 12. Now, it’s your turn, what is the objection to removing Section 12?
Here are some other things that you are obviously unaware of that I am for. I was and still am for the Ice River Spring deal. I spoke in favor of it at the public meeting and have written letters to the editor and comments on this blog in support of it. I was for employees of the school system getting pay raises and have written about that and have spoken at Commission Education Committee Meetings in favor. I was for tearing down the bus garage and building a new adequate facility. I even made a video of the garage and revealed for all to see the hazards involved with working there. In that video I also presented an interview that revealed the totally inadequate salary structure of those working in the garage. I have supported spending some extra money to build a courthouse annex near the jail and moving all the courts out there in order to save several hundred thousand dollars a year while providing security for the courts building. No other plan thus far presented offers any monetary savings to the county or increased security. I am a strong supporter of the Financial Management Reform that brings us into compliance with state requirements. I support a complete consolidation of water districts so all in the county can have abundant water and cheaper rates. I hope by now you get the picture that you so obviously missed during the past several years, I could continue with many other things that I am for but apparently if what I have already written is not enough your mind is already closed to that truth. The reason most post on this board: We are feed up with the lies' from Mrs. Vanzant for the past 5 years and her followers'.

We can not trust any thing that comes out of her mouth, and about one fourth of the commissioners.

A total lack of trust exist now exist with 60%+ of voting property owners'.

With new laws from the State this year, all elected officials will be held accountable for their ETHICAl behavior. If it's not good for the public as a whole, a voter can sue them and the county. This will put teeth into law the voters hands' to assure they do or pay the conscequences.

If the new owner of Milky Way wants to make his own town Fine.

If he wants to develope a gated community Fine.

If he wants special treatment that no one else receives NOT Fine.

If his deal is stright up as some think, let him present it to the commisioners for review in a Final Draft.
Then let the commission send it to the Assessor of Property for review.
Then let the Assessor of Property send it to the State Division of Property Assessment for review.
Then let it come back down the same change with comments and recommendations if any.
The commisssion should not be pressured to pass any think by a 2/3 vote in a rush, due to it basically makes it legal. After that anything send to the state is simply looked over to determine if it is legal or not.
DUUUDD, after the 2/3 vote the commissioners' made it legal!
Pull the wool over whos' eyes'??

This morning the County Budget Committee met and considered the issue of the Milky Way proposal. The following is the summarization statement in the letter sent by Mrs. Ginger Shofer the lawyer retained by the county to examine the proposal.

“To summarize, the Act is an attempt to expand to more residential type development the recognized financing structure of incremental property tax increase allocation in order to fund expansive public work projects. In weighing the value of such tax sharing with the developers, the County needs to also consider the issues involving the tax exemption for lands owned by the District as well as the issues surrounding liability for acts of the District, both the benefit of immunity to the developers and any exceptions to immunity because the District is structured as an instrumentality of Giles Count. The County should also consider the relevant merits and cost of potential litigation that may be forthcoming from anyone in opposition to the project, from the standpoint of the constitutionality of the corporate structure to whether the Act violates the land use control laws of the County.”

The two major issues in this proposal are these.
1) The District is being developed as an instrumentality of Giles County and thus places Giles County in the position of potentially being responsible for debts incurred and actions taken by the District and its employees.
2) Section 12 of the proposal states “The District, its properties at any time owned by it and the income and revenues therefrom shall be exempt from State, county and municipal taxation.” This is what is written not what is spoken about. The attorney specifically warns the county of “potential loss of tax revenue” as a result of this exemption.

Call your commissioners and ask them to have these two issues resolved before they vote on the proposal. Allen Barrett

Call your commissioners immediately. There is nothing in this for the county. The talk of waterlines, ambulance servcies, etc is all smoke and mirrors. This private act is about giving breaks to the rich, and not about Giles County. The debt issued by this district will be backed by the full taxing authority of Giles County. Plain language - if the development goes belly up, giles county taxpayers will be left holding the bag. To put this in perspective -there is not another district like this anywhere in Tennessee and there is a reason why there is not.

“One hundred percent of Milky Way taxes go to Giles County,” Ausburn said, explaining that only the tax assessments on Milky Way Farms residents would be used on the development. “The assessment funds would be added onto the tax bills of our residents. Although the district is a mechanism to create TIF funding through a small portion of the increase in taxes, 100 percent of the money goes back to county control into public works projects. None of the money from the tax generated funds escapes county approval.”
Example
Ausburn used one of the lots at the development as an example of what would be expected under the private act. The example is based on the tax assessor valuing the property based on its sale price.
Based on the average of all the property that now makes up the Milky Way Farms development, in 2006 one acre generated $19.35 in property taxes. When houses are built at the Milky Way is when the big boost comes. A one acre lot at Milky Way that was recently reserved and is scheduled to close in July at the value of $400,000 will generate $3,090 in property taxes.
With the 2006 tax total of $19.35 as the base, the increase in the property taxes due to higher property value will be $3,070.65.
Under the private act, no less than 85 percent of that increase — $2,610.05 — would go directly into the county’s coffers.
Up to 15 percent — $460.60 — would go to the district to retiring the bond for the public infrastructure.
“The $460.60 in this example goes to pay for public infrastructure that would be approved by the county commission,” Ausburn said. “Therefore 100 percent of the funds are used for the county’s benefit.”

Now, comment by anonymous...how can one argue that Giles County wouldn't be better off by receiving an ADDITIONAL $2,610.05 in property taxes?

Without a Private Act the taxes would be collected and used by the county anyway! Why should the county give up 15 percent to the District to do what the developer should be doing with HIS money, not the County's money? The District Board is not responsible to the County Commission. The county commission would not be approving where the 15 percent would be spent. Read the Private Act.

To Anonymous and MJV. You both raise interesting questions and have some good information but what you are speaking of is not exactly where the problem lies. If they want to have a basic tax of 15% above the county and keep it there much like an assessment in an association of owners that's fine. The problem isn't with anything Mr. Ausburn said, it's with what is written.
After corrections were made Section 12 on page 24 of the agreement states, "The District, its properties at any time owned by it and the income and revenues therefrom shall be exempt from state, county, and municipal taxation."
For me this has been the primary hold up. There are some minor things that need clarification and possible re-wording but it's the exemption from taxes that I'm most concerned with. Allen Barrett

As one Anonymous comments above, "Why the need for a Private Act" if properties are assessed as usual by the county tax assessor. The additional 15% could be part of the development's annual covenant charges.
Another thought, it would be expected that Mr. Ausburn is not in this project himself, he probably has shareholders. They are only looking for profit. I don't care what anyone says, he is not proposing this to Giles co citizens out of the goodness of his heart. Give me a break! This Private Act IS being rushed through. What is being covered up and/or the county attorny not seeing yet because he hasn't has time to study the Act. County DOES NOT need to get involved in this.

5-9-631 You & me both. Section 12 is a poison pill for Giles County and the state! Exempt from taxes means no taxes. Power to own, buy, sell, issue tax bonds for anything (homes, furnishings, amenities, etc., etc.)

NO TAXES, TAX EXEMPT BONDS FOR ALL DEVELOPMENT, INCLUDING HOMES, etc. I understand what he said. It simply isn't what he has written and expects our community to sign as a formal agreement.

Some of you are calling the 15 percent an assessment OVER the property tax the Milky Way residents would pay. As Ausburn told the Budget Com. up to 15 % of the property tax would go back to the District to be used for "public infrastructure" which is to help develop that District. He is making it sound like that money would be used for water lines, Richland School, etc. but that is NOT what the Private Act says. Where Ausburn says the money will go is not necessarily where it will go. ON TOP OF the property tax they will pay, those residents may be assessed an amount, which is common in some Homeowner's Associations.
Changing the wording by deleting "municipality" and calling the District an "instrumentality" of Gile Co. raises some important issues, one of which was brought up in the letter from an atty. hired by the County to look over this Private Act----"in structuring the District such that it is an instrumentality of the County, the potential for Giles County to be drawn into litigation over acts of the District and its employees should be acknowledged." That is pretty scary stuff. First National Bank has already loaned 5 million dollars to them---if the Private Act goes thru, if the loan is to the District which becomes the "instrumentality" then if they default on the loan the taxpayers of Giles Co. are liable for it???
If this is so up and up why do we need a Private Act? And why the rush to get it pushed thru the commission? They certainly didn't start work on the Private Act just a few weeks ago and all of a sudden he finds out the state legislature session ends the end of May. Something doesn't smell right here.

I certainly empathize Mr. Ausburn feels he's under the gun to get the project rolling now, anyone would be if they had a project they felt passionate about.

However, if this is a good idea for the county now, then it will be a good idea half a year from now. Lawmakers meet every January through May. We can afford to wait half a year for the next session to take up the matter.

Slow down, take the next few months to hold public meetings and work on the sticking points and then send it to Nashville in January.

How is the commission to know that what their high-priced attorneys have agreed to (for US the taxpayers !) is what will eventually find its way to the state ? ......and then back to the commission for final approval . There's LOTS of wiggle-room in this process for shenanigans ...BEWARE GILES COUNTY .

Been out of town and just returned to read the Thursday edition of the Free Press. The attorney hired by the county is making some very good points, points that should not be ignored. She states that portions of the act are not provided in state law. The question in my mind becomes if state law does not allow them to do parts of this act then why on earth is the county commission even considering this private act? Her next point is the act could be challenged for constitutional and other reasons. Another good reason to apply the brakes.

Something this attorney did not mention is how will this act impact the county's financial statements? It is my professional belief this will be considered a component unit of Giles County Government meaning that its financial statements will be presented as part of Giles County's financial statements. Its assets, liabilities and debt will all be included in Giles County's bottom line.

Also, the property owned by the district will not be subject to tax. I believe they are going to be developing a golf course, horse riding arena, etc. If these propereties are transfered to district ownership then Giles County will lose much needed tax revenues. And then comes the question will bonded debt be issued for these improvements? If so this will be backed by the full faith and credit of all giles county tax payers.

There has not been enough of a study for the commission to even begin to consider such an act. Shame on those commissioners who have forced this special called session. They have not had time to understand and they are not using sound judgement in this matter.

I could not agree more. I am also tired of hearing about how the County Executive treated these so "very nice" developers. She is entitiled to her opinion and in my book she has done an excellant job of handling this very awkward situation.

If Scotty wants to criticize someone he needs to start with the commissioners who had the audacity to call this special called meeting. How can they even begin to understand this important issue without the help of legal counsel. I guess they are just supposed to believe these "fine developers" becasue they have money and memphis lawyers.

Sounds like scotty wants to play golf with Viney at the million(s) dollar golf course backed by your tax dollars. It is a pathetic newspaper.

What should be a wonderful thing happening in Giles County is turning into a nasty situation - simply because that is exactly what it appears to be!

Our county executive was apparently called a red neck with no brains. A later apology should have resolved the matter. Later, The county executive appears to have been given a new private act copy just before the meeting to approve it! Further, some commissioners had prior private access to that private act, in a private meeting, and fully intended to ram their private act down the throat of Giles County! Janet had every right and obligation to do what she did. Most people would have said & did a lot more.

Section 12 remains in the act! WHY!!!!
1) It unequivocally states that "the District, its properties at any time owned by it and the income and revenues therefrom shall be exempt from state, county, and municipal taxation." That which is written into the act is what will be binding, NOT ANY VERBAL statements or promises. It is an all inclusive exemption that no other citizen or business in Giles county has!

2) It further states, "... bonds issued by the district shall be deemed to be securities issued by a public instrumentality or a political subdivision of the State. The interest rate on municipal tax exempt bonds is a fraction of private sector bonds, loans, or other financing arrangements for PRIVATE PERSONAL PROPERTY! If we decide to fence the farm, improve a business, build a fish pond, pave the drive, DRILL A WELL, PUT IN A SEPTIC SYSTEM, or anything else, we pay full sales tax and property tax on it and there is no low interest tax exempt bond or other favorable financing available!

Section 9 notes "The District ... bonds ... to finance ... construction, purchase, acquisition, extension, maintenance, and operation of improvements" - THE POWER AND RIGHT TO DO ANYTHING THEY WANT TO DO! It separately notes, "...the power to issue bonds ... to finance the costs associated with public works ..." TWO SEPARATE THINGS - ONE PRIVATE & THE OTHER POSSIBLY PUBLIC - things NOT available to other citizens or businesses!!!!!

The DISTRICT, as defined within the agreement, is anything but a computer on some clerk's desk! There are no stated limitations on how much money can be raised by tax exempt bond issue nor any restriction of what the money can be used for!

The county has absolutely no business trying to run, administer, or be involved in individual or collective owed property, being a collection agency, or anything beyond its current functions.

A good test of faith would be some personal endorsements backed up by agreeing to civil and criminal liability for any promises or statements! Let's include the lawyers in it.

If you have to buy a friend, you will be disappointed in what you get. Get real - dump the act & wish them well on whatever they want to do. Janet - God gave us a few good old red neck girls, cause they know how to keep the fox & weasels out of the hen house - THANKS! Let there be peace back in the valley.

There is a big tax problem hidden in this mess. Let's call it the loan tax.

State and local sales tax applies to building materials, furnishings, appliances, etc. Most home construction is financed by loans, not income or savings!

If a million dollar home paid 9% tax on half of it, they would have paid the state & the school system $45,000 before anyone moved in! If you think about it, Rutherford County & Spring Hill dumped a ton of money in the state treasury - not for infrastructure where the homes were built! The state, like a child with the key to a candy store, blows the money to the four winds.

The city has an answer - charge the new home owner a a few thousand dollar privilege fee to build the house, on top of the sewer tap, water tap, fees, driveways, streets, endless bureaucrats, and of course, the sales taxes. The Municipal League, union of mayors, union of county mayors, association of educational administrators, TEA, NEA, American Banker's Assn., and the CCP will make sure the home buyer is totally indentured before they open the front door.

Solution? Scrap the private act boondoggle. Pass a law to reserve all building material, etc. taxes for infrastructure of substance - (nothing for administrative or bureaucracy) Provide a refund for those in the country who provide their own water & sewer. The MW infrastructure problem would disappear!

Today common-sense prevailed in the Giles County Commission . They who had called their Special Meeting at the behest of the Milky Way developers were soundly defeated when it came to the vote .
This IS what democracy is about and a big 'thanks' is due to the commissioners for their votes AND to Mrs Vanzant for hiring an attorney who knows the law and can express herself well .The County needs to remember who voted 'for' this project and vote the rascals out at the next election.
There can be little doubt that eventually the MW project will bring some benefits to the county but this bludgeoning approach was the wrong way to do it . Now it is time for all concerned to sit down and discuss how to make it work for all the taxpayers in the county .

Today the County Commission voted not to send the Milky Way resolution to the state for approval. I’m still not sure if some realized what it was they voted on.
There are some questions that came to light and should be of concern for all citizens.
1st How much has been and will be spent on the attorney from Fayetteville?
2nt Who authorized retaining the attorney from Fayetteville?
3rd Was the County Attorney not capable of rendering an opinion on this matter that could have been handled by a second year law student?
4th If the County Attorney is not capable of handling such a matter, why is he the County Attorney?
5th Was this another example of the County Executive simply shopping around for someone who would agree with her?
6th Of the eight Commissioners that voted for the resolution how many actually read it and will say they felt comfortable with the resolution as written?
7th Of the eight who voted for the resolution how many are willing to explain why Section 12 isn’t simply deleted if there is no intention of the district ever being tax exempt? Allen Barrett

To Ole Hickory, Yes I was at the meeting. I even asked to be allowed to speak after the rules were suspended and Mr. Ausburn was allowed to speak in favor of passage. I was not allowed to address the two issues that give me the most trouble. Now the reason I asked to speak is because out of the twenty commissioners that were there only six had any questions and only one asked a direct question about section 12 and that was done in a very passive, apologetic manner.
I am and have been very much in favor of this project. I see it as being one of the most significant benefits to all of Giles County in many, many years. The problem for me centers directly on Section 12 page 24. Mr. Ausburn has said that they do not seek any tax exemption but this is what Section 12 states, you can be the judge of what it means but for me the written agreement carries far more weight than does a verbal agreement.

“Section 12. Tax Exempt
The District, its properties at any time owned by it and the income and revenues therefrom shall be exempt from state, county and municipal taxation. Bonds, notes and refunding bonds issued by the District and the income therefrom shall be exempt from all State, county and municipal taxation, except inheritance, transfer and estate taxes, or except as otherwise provided by state law. For purposes of Tennessee Code Annotated, Title 48, Chapter 2, and any amendments thereto or substitution therefor, bonds issued by the District shall be deemed to be securities issued by a public instrumentality or a political subdivision of the State.”

There are some minor parts of the agreement that need to be worked out and clarified; for the most part I don’t believe them to be major obstacles. Article 12 should be a deal breaker if it remains in the agreement.
After speaking with several commissioners I know they do not fully understand what they voted for. As was mentioned during the meeting by two commissioners that were of the belief if they passed the resolution and then it was passed the state our county commission would then be able to make changes, corrections etc.
At least two commissioners had not read far enough into the resolution to even know there was a section twelve. I get very frustrated with the commission at times but realize it’s not simply their fault for not knowing certain things. For the most part they’re just average people trying to perform an incredible task. Most average people in the state have very little idea of what goes on in government. I certainly know that for me the more I dig past the surface the uglier it gets.

Sometime back, I awoke and found myself in the midst of a real screwed up county government. The nightmare was reality.

The other morning I awoke and found my government had a solid majority of people who did a better job than I know I could have done. What a good feeling!

The nightmare was forced agreement without understanding. When the spoken words don't match the written words, we have no understanding. If there is no understanding, there can be no agreement. The war of wits boiled down to the wisdom of truth defeating the cunning of knowledge. It's a profound change!

The commissioners are doing a better job because they are being watched more closely, being held accountable and some are committed to doing what they promised before being elected and listening to those in their community. The big test will be on the matter of taxes and a wheel tax. I fully agree they should be complimented when they act responsibly.

Allen Barrett wrote an excellent letter to editor about this rate hike in paper dated 5-15-07. He asks that all Giles Co citizens who possibly can to attend next City Council meeting. This we ought to do as it will effect everybody's water bills who is on any water district. Mr Barrett can you post on this blog when that meeting will be?

The wheel tax fiasco is the brain child of Lovell - he hasn't seen a tax increase he don't like. Look at the spending follies comments section - sale tax revenuse are WAY UP (14.4%) in the two year audit times of 2005-6 compaired to 2003-4. The fact that Jackson fakes budgeted revenue doesn't mean the revenue isn't there! Wake up!

The highway dept needs some help. - add a temporary rate increase to property or sales tax & stop it out when it isn't needed.

Better yet - take all real revenue over Jackson's fake budget revenue & give the highway department whatever they want. Take the million or so that is left over, have a lottery drawing & pass it out to 10 giles county residents!

According to Barrett, Jackson got a $6+ million increase in 2004-5, while every other department's stocking got coal! Lying paid well back then. It's time for the what goes around thing to come back around! A fake paycheck & pick slip would work.

Forgive me I did not read all the posts yesterday. Section 12 was a really big issue to me. But something else bothers me about the private act.

The private act creates a special taxing district. State law allows taxing districts - for instance state law allows county govts. to establish a special taxing district for solid waste. And in this instance property taxes collected in the district are used to pay for solid waste services in the district.

There is also case law - specifically Kennedy vs Montgomery that states citizens cannot be taxed for one purpose and have the monies used for something else. What this means is that tax money allocated to the Highway dept cannot be used for school expenditures nor could monies allocated to the General Fund be used to pay for Highway Dept expenditures, etc.

Based on these two issues I doubt the private act would hold up in court if a taxpayer in the milky way district became upset over the monies being used to pay for projects outside the district and filed a lawsut challenging the private act in court.

The County Commission can establish a capital projects fund and allocate a portion of the tax rate to go into the fund to pay for needed capital projects all over the county. This is legal, simple and does not involve jumping in be with a developer.

The city council meets on the 2nd and the 4th Tuesday each month at noon. Next meeting where the final vote on the huge water rate increase is scheduled for Tuesday 22 May at noon.

Do you agree with the way the county executive treated Mr. Ausburn when he went before the commission? Passing out false information about his company to everyone in attendance and her lack of personality constraints was an embarrassment to me. I don’t think I have ever witnessed anyone so power hungry as she is and will do just about anything to achieve it.

A citizen of the Lynnville community told me recently, “I went to Janet’s office and spoke to her about the MW project and she assured me, SHE WOULD VOTE FOR THE PROJECT,” and then he said, “She has never lied to me before.” I tried to tell my buddy the truth but he wouldn’t listen, after my phone call to him, he had to admit she lied to him.

Her conduct scares me more than the MW project.

The way she treated Mr. Ausburn was shameful but was no different than she has treated me and a number of other people on any number of occasions. I recently went to her office to get copies of the evaluation letters for the Financial Director applicants. Her former shadow went outside to find a sheriff's deputy who actually came and sat in her office the entire time I was there. When I left her office it was only moments later that he left.
I and others who have had personal dealings with her have tried to inform people of the county about her lack of truthfulness and integrity but for the most part that information has been met the same way your friend reacted to your experience. She can make a great first impression but only a small involvement will reveal a very petty, undisciplined, very insecure Pseudo-Potentate. Allen Barrett

I would like to call all our commissioners out right here and right now and ask them to explain to me, A Giles County District 5 taxpayer their reasons for voting against the MW proposal. Don't assume that I am for this proposal but it seems that once it was voted to send to the state legislature wouldn't that have given them ample time to research the proposal instead of just killing it in the head??? My mother lives in the north end of the county and still has to depend on her spring to get water into the house for bathing and still it's not fit to drink! She can forget about washing clothes when it rains!!!!! I am asking for explanations!!! And by the way for the smart alecks who read this, I WILL be writing my commissioners as well but I thought this was a quicker way to get the word out.

I live in District 5 and I didn't support my commissioners to vote no, but I didn’t for one-minute think either of them would vote against what Vanzant wants. They vote as a group and she is the leader of that group. My suggestion to you is to attend a few county commissioner meetings and it won’t take long for you to understand what goes on between her and the group of commissioners that will always vote, as she wants them to. The only way to solve the problem is to vote both Howell and Pollard out of office.

I think you make a good point as there being time to learn more while the proposal went to the state.

I too live in District 5 and resent the suggestion Howell & Pollard be voted out of office. You oughta be thinking in terms of Holt. He's been on the commission for way too long and never does anything inovative except vote for EVERYTHING to be raised. If you attend some county meetings you will hear Pollard and Howell voting and talking against what Vanzant wants. In the instance of the MW private act, both those commissioners were voting upon the majority of their constituents and you cant fault those people for that. Its what its all about bud.

There is simply nothing wrong with being pro-growth in a responsible manner. If Giles County does not move forward, it WILL move backwards. Any simpleton can say "look how little we're spending...ain't we good stewards of the tax dollars?" Well this is not always the smartest choice. As in all aspects of life, you HAVE to invest first in order to receive a return later.

Mr. Barrett, you are an extremely intelligent individual. I say this with all sincerity...read and apply the principals from "How to Win Friends and Influence People" by Dale Carnegie. In the future you would spend much less time explaining your perceived acrimonious actions - however noble they may be - and receive the additional benefit of being more efficient with your time.

Meanwhile as the various factions continue to snipe at one another, the other counties around us will continue to snicker at our ineptitude - AND, build new schools, attract new industries, etc. etc.

I didn’t feel mistreated by Mrs Vanzant when the deputy arrived, in fact she was more pleasant that usual. Come to think of it every time I’ve had my camera with me she has been much nicer. I feel that I have been mistreated every time she has lied to me. I feel mistreated every time she has used her power and influence to abuse my rights or singled me out for punitive actions, or to spread untrue comments about me. I certainly felt abused when the county commission voted to allow me to address them then when I approached the podium she made the announcement that commissioners were not required to remain in the room while I spoke.

I grew up in the housing projects of Murfreesboro and spent 20 years as a soldier I have a very tough skin. I do however have a problem with people who disregard my Constitutional and human rights and the rights of others. I do get frustrated when someone tries to make me believe something totally wrong or stupid and I can not abide a liar. While you say I am arrogant, I have had no one who knows me make that same claim. Perhaps you misunderstand that arrogance is an overbearing pride or self-importance and people who know me do not consider that as part of my personality. I believe because I take some clear cut, right or wrong stands some perceive that as arrogance but please understand being confident in your beliefs is not arrogance as long as your beliefs can be justified and do not diminish those holding different beliefs. One big problem for me is when others have used their power to limit or exclude me simply because they can not defend their positions. When I am allowed to speak it is often with sever time restrictions. Trying to concentrate five minutes of words into two minutes doesn’t leave much room for gentle phrasing. Allen Barrett

She wants TOTAL control of the court house and get very upset if any one questions any thing she says or does.

People like you can never be satisfied no matter what the Commissioners do. Maybe you should have considered writing or calling your commissioners BEFORE the vote on the Milky Way issue. I can assure you that the 2 Commissoners whom you criticize would have gladly considered your wishes before they voted, just as they did the Citizens who DID take the time to contact them. I spoke to both Commissioner Howell and Commissioner Pollard and was treated with the utmost respect. I did, however, speak to more Citizens in our District who opposed the Milky Way Plan than those who approved of it. Maybe you should consider the fact that these Commissioners voted the way that the majority in the 5th district wanted them to vote. They are, after all, obligated to consider what the majority of the voters who elected them want.

White sounds like he got his hand caught in the cookie jar & run off crying to mama. Haven't heard one person say they didn't want Milky Way developed, prosperous, & successful. Have you?

Do you know of anyone in the county who doesn't pay sales & property tax on all personal possessions? If you have a pool, you paid sales tax & then property tax forever after. Your driveway is taxed, your bushes are taxed, your garage is taxed, your well is taxes, your septic tank is taxed, your trailer is taxed, your lawnmower & its gas is taxed, & your toilet paper is taxed! If you borrowed money to do it, it wasn't a half price interest tax exempt loan! If you go to a public rest room, IT'S FREE! Milky way gonna lock the gate & doors!

All of us have a problem. It's called runaway tax and crazy spending ... By a very few, with big plans on what to do with someone else's life and money! If you, me, or Milky way builds a house, the materials and furnishings are taxed at almost 10%, long before move in and use any public services. Instead of it going for public or private supplied utilities & stuff, a chunk goes to the schools so Jackson can build a nest, and the really big pot goes to the state so they can send more to Jackson & have tax free days. Because some leaders can't find it or figure out where it went, privilege taxes are passed to whack the new home owner twice for infrastructure. It happens to all of us! - Why not force a law that says all home construction & furnishings taxes got to infrastructure, or back to the home owner if no infrastructure is offered.

Milky Way has another problem. If they developed the area with $380,000 of amenities and a $20,000 lot, taxed at $400,000 total, they might be getting screwed just like us. If the $380,000 goodies remain taxable & the lot is $400,00 all of a sudden the tax base is $780,000 plus the million dollar home (maybe). That's the big one! A simple solution is sell the lot for $20K on the condition that they must pay $380K for their share of the goodies. Then, they'd be getting the same shaft we get. Problem - Holt, Lovell, Reedy, & Woodard & white want to make all of theirs tax free - no taxes - plus pay half price for their tax exempt loan! The shear excitement of getting to pop it to the citizens again got the best of Lovell. He just couldn't hold it back! "we gotta have a wheel tax!" I'll bet, for a hundred dollars, Mrs. Wade could get him a hat shaped like a wheel & a smiley Wal Mart sticker to past on his license plate. That way everyone would know he wants to tax wheels, too! That bunch never saw a tax they didn't like.

Butch White is one of the most giving people here in Giles County. There is no telling how much money and food he has donated to the many different organizations here and you have the nerve to berate him because he resigned because he feels the people were being treated wrong. He was one of few commissioner who actually had a backbone.
If you decide not to eat at his business good that leaves more food for those who know what good food tastes like. When he resigned GC lost a very good commissioner who always did what he thought was best for the people of Giles county and had no problem expressing his opinion when he thought something was wrong.

Don't know Butch - may be a good person? Just think if an official goes go off on someone publically calling them liars an so on, they need to say exactly what the lies are or keep quiet. Ms. VanZ gets a lot of hissin at her over lies - some is ok changing of the mind when someone is trying to pull a fast one (MW Farm!)

I do know your taxem heros will support deceit, which is a long series of lies with big tax spending $$$ on it. Lovell's wheel tax has a flat that can't he cant fix. The school budget revenue was falsified in the 2004-5 all the way to now. They're educated people & know exactly what's going on - pulling the wool over taxpayers eyes to spend, spend, and more spend! Not one of them can argue or prove Barretts exposing of the spending for everything except teaching & books! Did you ever learn anything by taking up money (taxes) to faten a fat cat? Been there & I learned to feed my family & sic the dogs of the cat! The family & neighbors who taught me that did it free - out of the goodness of their hearts! What good is knowing how to add & subtract, if you don't have enough sense to stop someone from taking what little you do have?

5/21 6;30 anonymous I AGREE 100% When we lost Butch we lost one of our better commissioners. Even though I did not agree with him on the MW deal. I still think the majority of the time he had the best interest of the county at heart. He was not afraid to speak up or vote for what he thought was right. If the developers of MW had brought their issue before the commission sooner they would have had more time to study and make changes. In my oppinion if there could have be a time limit on the tax exemption it would have passed, but the writing in the proposal was open ended. Down the road the writing would be what counted not things said verbally.

Much is being said about Butch White. I disagreed with him on many occasions and felt many times that he wasn’t as fully involved with county business as he could have been.
I am disappointed in the way he resigned. I think he could have served the county better by making his statement, which I fully agree with, in the county commission meeting and then resign if he wanted to.
Mr. White did not accept his commissioner pay and what he has given in terms of support to this county and it’s organizations is far beyond comparison to what most other individuals and even many groups have done.
I always found him approachable even if at times somewhat cantankerous. For me the most important thing, and something that is missing from many other county leaders, is when he said a thing I didn’t have to worry if he was telling others something different.
I respect Butch White. Allen Barrett

When I referred to Mr. White as “cantankerous” it was not used as a derogatory term but more in terms of describing him as a “Gabby Hayes” type personality, lovable but cranky.

Malcontent is a mild description of what I feel about fraud, deception, and waste in the most precious institution outside the realm of God - called public education. Anyone who condones or defends corruption, falsifying reports to obtain money, fudging test scores to look good, saying you saved money in a period of runaway spending, or falsely telling parents and children that they excel when the opposite is true ... qualifies one as a real piece of dirt! Did you read the Tennessean today? There is nothing wrong with being average and unqualified to be a brain surgeon. There is something real sick at telling someone they are a high achiever when they can't even add. It destroys lives! Who said anything about believing that the "sky-pixie" had a son? That's an entirely different issue altogether.

You have no choice but to believe that a cloud of hydrogen, given time and luck, "evolved" into the universe as we know it. Or you MUST believe that a higher intelligence -- ie, a sky-pixie -- was involved in some way. There is no middle ground.... this is an either/or type of issue.

So which do you want to believe in?

An incredibly lucky cloud of hydrogen? Or some sort of intelligent creator?

People who don't worship the God that created the universe, tend to worship government. (Of course, that's not entirely their fault, seeing as how the "educational" system is designed to promote disbelief in God, and worship of government.)

Government worship tends to lead to very bad things, such as genocide and mass murder. Twentieth century governments, the vast majority of them "officially" atheist, killed in excess of 250 million people.

6-12-7 02;43;00 - 11;38;00 The school budget is the only budget that has been consistently criticized over the past 4 years. T Jackson has been named more times than any of us can count - is one more reference good enough for you? He could stop it, but year after year pulls the same crap over and over.

There are many entries detailing fraud, etc., SIGNED by individuals who are not hiding from you or anyone else. Printed documents with names on them have been given out over the past 4 years. No one cares what you think or say - it's an empty space devoid of morality or character. You speak with no truth, foment distrust, and work tirelessly to corrupt all that you touch. You are a cancer within the school system, like an abcessed tooth.

Cat got your tounge on the falsified sales tax, BEP, inflation, raises for administration??? Can't get your britches up on the 2004-5,05-6, & 6-7 scams? Lots of various documentation & articles - all about the school admin NUMBERS - theirs, not someone else's.

Moral relativity is amoral - no substance, just chatter like a chipmunk. Laughable to the sick, serious to those who have values or mouths to feed. Yes, you are one of the dots, wiggling on a string.

What a laugh! You are dead wrong if you think I don't admire him and believe wholeheartedly in what he stood for.
Furthermore, if you have all this evidence, why don't you turn it over to or call it to the attention of the authorities who, incidentally, are in a much better position to do something about it than you are. That would seem a better approach than all the endless whining on this blog. If things are as bad as you say, then surely the charges could be prosecuted. Would you agree?

I find it hard to believe that the police and the courts would do nothing when presented with hard evidence.
So what's the worst case scenario here? If the legal system will do nothing, then you simply have to wait and use the democratic process of removing people from office. In short, vote them out. Frustrating as that may be, it appears your only alternative.
What good does it do to get on here making accusations and calling people names? That can't be the way to do it. I often wonder if those who have been guilty of doing this ever consider that these "evil" officials have family and friends who might see their posts. I think that is a real shame.

There is nothing to prosecute because there is nothing wrong. Just a few folks who have nothing to do commenting on something they do not understand. Giles County has an audit every year - I have yet to see a finding concerning all this supposed "falsified sales tax, BEP, inflation, raises for administration???" accounting nightmare. And why is this - because there is not one.

If you think nothing is wrong you are sadly mistaken. Yes there is an audit every year but it DOES NOT include the budgets. The County Executive has been asked more than once to request a state audit of the budget but while promising to do so has not, to this date. Even the regular audit has uncovered enough for serious criticism such as double billing paid, same person taking in money, posting it and disbursing it, no bid contracts given, and specs for a bid written to benefit one bidder. Prosecution is a problem in that there will have to be either a private suit filed which takes a lot of money or the public has to rise up and demand action be taken which takes time and interest. Most people are aware that there are problems but are so busy trying to feed their family and pay their taxes that they don't have the energy to do battle with corrupt officials. Please, for the benefit of my anonymous friend, understand I use the word corrupt in terms of being deteriorated from normal or a standard.
The other part is that giving raises to administration is not necessarily a crime. The way it has continuously been done here is just very deceptive. It seems when money is given to fix roofs or to give teachers a raise the greater percentage has gone into administration. Many of the commissioners have now caught on to this scam and are more reluctant to approve increases in the school budget not because they are opposed to education but the deceptions.
