HIGHLIGHTS OF GILES COUNTY AUDIT ENDED 30 JUNE 2010

OFFICE OF THE FINANCIAL DIRECTOR

FINDING 10.01 SOME AMBULANCE SERVICE COLLECTIONS WERE NOT DEPOSITED WITHIN THREE DAYS OF RECEIPT.

In some instances, collections at the Ambulance Service were not deposited with the County Trustee within three days of receipt. Section 5-8-207, Tennessee Code Annotated, requires county officials to deposit public funds within three days of receiving the funds. This deficiency can be attributed to a lack of management oversight. The delay in depositing the collections increases the risk of fraud and misappropriation..

RECOMMENDATION: Officials should ensure that all collections at the Ambulance Service are deposited with the County Trustee within three days of receipt as required by state statute.

FINDING 10.02 A COMPUTER AND TIRES WERE REPORTED STOLEN FROM THE EMERGENCY MANAGEMENT OFFICE
(Internal Control – Significant Deficiency Under Government Auding Satandards)

The thief of a laptop computer and tires from the Giles County Emergency Management Office was reported to the state Comptroller’s Office on January 12, 2010. The computer and the tires were valued at $1,200 and $300, respectively. A police report has been filed with the County Sheriff’s Department, and the matter is under investigation.

OFFICE OF CLERK AND MASTER

FINDING 10.03 THE OFFICE HAD DEFICIENCIES IN COMPUTER SYSTEM BACKUP PROCEDURES (Noncompliance Under Government Auditing Standards)

System backups were not regularly stored off site. Section 10-7-121, Tennessee Code Annotated, provides that records required to be retained by any government official may be maintained on a computer or removable storage media as long as certain standards are met. One of these standards requires that all data generated and stored within the computer system should be copied to storage media daily, and media more than one week old should be stored at an off-site location. This deficiency is the result of management’s failure to implement adequate disaster recovery planning procedures. In the event of a disaster, all backup data could be destroyed, resulting in costly delays in generating and recording information accounted for through the automated process. The office began taking backups off site in July 2010. Proper system backup procedures are now in place.

OTHER FINDING AND RECOMMENDATION

FINDING 10-04 DUTIES WERE NOT SEGREGATED ADEQUATELY IN THE OFFICES OF CLERK AND MASTER AND REGISTER (Internal Control- Significant Deficiency Under Government Auditing Standards)

Duties were not segregated adequately among the officials and employees in the Office of Clerk and Master and Register. The officials and employees responsible for maintaining accounting records were also involved in receipting, depositing, and/or disbursing funds. Accounting standards provide that internal controls be designed to provide reasonable assurance of the reliability in financial reporting and of the effectiveness and efficiency in operations. This lack of segregation of duties is the result of management’s decision s based on the availability of financial resources and is a significant deficiency in internal controls that increases the risk of unauthorized transactions. Also, this deficiency is the result of management’s failure to correct the finding noted in the prior-year audit report.

RECOMMENDATION: The clerk and master and register should segregate duties to the extent possible using available resources.

MANAGEMENT’S RESPONSE – REGISTER: The cost of hiring enough employees to segregate each step involved is not feasible for the Tegister’s Office. We now have only two employees in the office. The budget will not allow us to increase our staff to comply with this recommendation.

AUDITOR’S COMMENT: We have not recommended hiring additional employees. We realize that due to limited resources and personnel, management may not be able to fully segregate duties among employees. However, duties should be segregated to the extent possible.

Last years audit was better than this one.
It's the same laziness that kept teachers from getting paid on time and insurance from being paid on time that allows money to be deposited late.
Leadership is still missing.

It is about time that elected officials understand that they work for the citizens and that they are anserable to the citizens. Granted most citizens don't give a damn and do not want ot be involved; but, the County Commission work for us, you, me, and everyone who lives and works in Giles County. We do not work for them.

Once that thought is fully understood by our elected officials; and that they are to do what we want, not what they waht; then maybe just maybe Giles County might move forward

Dec 26 at 11:08 AM and 5:59 PM are one in the same person. I am the same person who is tired of our exalted elected leaders placing themselves above the average masses. Terry Harwell, Stoney Jackson and Tommy Campbell are the extreme examples of arrogance (“I’m a County Commissioner and what are you going to do about it”?) and do not reflect the attitude of all our Commissioners. YES we do have some very good and faithful Commissioners who go out of their way to do what is best for the Giles County citizens (Connie Howell, Tom Pollard, Roger Reedy for example). I have suggested to the Home Rule Charter Commission that the number of Commissioners be reduced to at least 14. It is about time that WE the voting public standup and take charge of our local government which likes to spend, spend, spend.

TO: Dec 26 at 9:56 PM I have no animosity towards you and I have fought to insure your right to free speech. Yes I have the wounds and the medals to prove it. BUT it is time Giles County citizens take back what is their’s a government for the people, by the people and of the people. Not a select few.

You quoted Terry Harwell in defense of your claim, and his statement didn't reflect the arrogance you suggest. He was provoked. Have you never said something in anger that you wish you had said another way or perhaps not at all? Of course. We all have.
You mentioned standing up and taking charge of our local government. Are you suggesting a rebellion? Those seem dangerous words, and I am glad those who feel that way are not being elected.

I am a taxpayer who always tries to pay my taxes by the end of the year but when I went to the Trustee's office on Wednesday the 22nd of December, they were closed. Can you please tell me why would the courthouse offices close 3 days before Christmas. I am getting real aggrevated at this for I work and there is no time for me to get there before they close at 4:00 and when I take an early lunch break to get my taxes paid Mrs. Townsend and the other offices take it upon themselves to close their offices when they need to be open to serve we the people. This has got to stop and we have to gain back control of our courthouse. Elected officials have forgotten who they are working for. I for one will not forget this next election time. Why can't they stay open until 4:30 and give us working class people a chance to get there and do business. For heaven sake, open up on Saturday Mornings if need be. FED UP!

What are the court house hours? I've always been able to go just after 1, so never paid any attention to what the hours were.

I remember in the past some ran on they would see the courthouse was open on Saturday morning. But when the got elected they were over ruled by others. That could of happen 30 years ago, time goes by so quickly.

I realize so many work out of town or state and it is hard to get to the courthouse if you don't have a spouse to go for you.

When one person and goes ask for the courthouse open longer want do any good but if it's discussed then several will ask might do some good.
The county or city mayor can't do it alone. There are lots of people working in the courthouse that would have to agree.

I've never liked petitions and refused to sign them, but would it help to start one for Saturday mornings at least once a month.

I remember several years ago that the Court House was closed one afternoon a week and then open on Saturday. It's six of on and half dozen of another about this issue. Would you rather it be closed one afternoon? As you would know, it would be that afternoon each week that you need for it to be open. If someone is there on Saturday, would you have to give time off or pay overtime for a Saturday work day? It makes for a hard decision on the part of all concerned. What's the answer?

I believe in mailing in every payment I can, but car tags would call for me going into the courthouse.

does anyone know why the courthouse quit taking off on Thursday afternoon and not working on Saturday. What do other counties do?

Didn't I hear something about post offices may stop staying open 5 days a week?

There would be no overtime involved if the courthouse and annex were open on Saturdays since they only work 35 hours a week anyway. Overtime starts after 40 hours so they could easily be open on Saturdays. Current hours are 8:00 a.m. to 4 p.m. with an hour off for lunch.

Look at a county policy book and find out what the holidays are. County employees and I think state employees work a 35 hour week. While overtime does not start until after 40, extra pay would have to be paid since their hours are figured on a 35 hour week, any additional hours have to be paid for at an hourly rate.

Makes no difference what the local policy book says. That could be changed by a vote of the commissioners. Federal law says overtime begins after 40 hours. There is no reason county employees should be only working a 35 hour week. This all came about under the county executive who suddenly announced the courthouse would start closing at 4 pm which created the 35 hour week. Its time the county employees came down to the reality of employees in the private sector. Also, if anyone wants to read the county employee policy they will be shocked at the number of holidays received annually, again, as opposed to the private sector. Incidentally, Lincoln county employees work more than 35 hours a week I believe they get 30 minutes for lunch and close at 4:30 pm.

How about a really cool idea that is possible???

Why not have the proposed Home Rule Charter stipulate that County Offices provide services for 40 hours per week to include four hours on Saturdays? That would include the 7 hours per week day and the the 4 hours on Saturday for a grand total of 39 hours. Oh yea, the 7 hours during the week day also includes their "lunch hour".

The Charter would only need the approval of a majority of citizens and not the County Executive or County Commission. If approved the County Office would have no choice but be open.

I still think there is enough employees in each office to rotate hours to be open 4 hours on Saturday. Leaving the 35 hours a week and not going over 40.

I can see how most want the government office to put in as many hours as other places. But when once given it's hard to take away.

How many hours a week does the road department work. They are off all day Friday. This isn't a complaint because I know emergency can cause them to work Saturday and
Sunday.

Don't most of the counties around us operate on an 8:00-4:00 work day? If you go to the larger cities, it's 9:00 to 5:00. Is that not the same total working hours? No matter what the hours are, it will not satisfy all the needs of the citizenry. Like the earlier post said, he/she would like to see the banks and post office stay open longer too. 4:00 is early in the private sector to close shop. Comparing the private and public is like oranges and apples almost.

Seems like when I first went to work in a factory, we had to be there by 7 and got off at 3:30, that gave us 8 hours of work and 30 minutes for lunch. You can tell that's been many a day. I thought all places put in 8 hours working and the time off for lunch wasn't paid for.

Oh well, Time changes everything.

8:01 You are right and things havent changed. My work day is 8:30 - 5:00, 1/2 for lunch which is not paid for. Its also a salaried job (which I believe county employees are on) and any hours over 8 each day I give to the company as part of my job and expected of an employee on salary rather than hourly. No extra pay. Not complaining. Just glad I have a job in this economy.

7:21 I'm not sure if it's 8 to 4 or 8:30 to 4:30. You are right it's 8 hours but it's not deducting the lunch hour or 30 minutes. The lunch time is one of the good advantages they are given.
Good for them. Some places don't give the employee anything.

Could it also be that this sudden whining about office hours is a clever attempt to get something written into the so-called charter that would force county offices to stay open beyond what they are already doing? I know some have for years wanted the courthouse open on Saturday. Some work out of town and have a hard time getting to the courthouse in the hours now open. Even if you work in Pulaski you have to go to work before the courthouse opens and it's closed when you get off.

I remember a time when it was open for a few hours on Saturday.

Several people have promised if elected they would see the courthouse was open on Saturday only to find out one person can't change anything.

As for the charter,I don't know that anything can be done with it or without it.

The proposed Giles County Home Rule Charter can mandate office hours. The Charter can mandate that Courthouse offices be open until a certin time in the evening and/or Saturdays. However, it is the will of the people that will dictate what is in the Home Rule Charter. If you are interested in providing your input you need to atten the Charter Committee meeting that are held every Monday evening at 5:00 Pm in the Courthouse Annex basement boardroom.

5:52 The county charter currently being wrtitten is NOT a "so-called" charter. Its a BIG REALITY and very much within the law. Accept the process whether you like it or not. The people got tired of what goes on in county government and under the current leadership they decided to try to do something about it. Its completely out of the hands of the county employees and elected officials and be up to a vote of the people in August 2012.

I saw on WKSR where when the Charter met the cutting back of commissioner was talked about.

Giles County is great about getting roads ready. Have you ever tried to go south in this kind of weather. When you hit the Alabama line it is horrible. They don't do anything about the roads and the first couple of miles on 65 in Alabama are dangerous in the best conditions.

The problem with a nonspecific topic Blog is you have anonymous posters, putting forth assertions that are impossible to prove.

I challenge Mr. Barrett to examine his motive in continuing this Blog by asking himself this one question:

Does the existence of this Blog provide potential solutions for the betterment of Pulaski and Giles County? Or, has it served as a platform of frustration, hate and mistrust?

Although I am skeptical Mr. Barrett would discontinue this Blog, his answer to that question should guide his actions as to whether or not this Blog (in its current form) should continue.

Successful Blogs that I’m a member of are those that serve a specific interest - i.e. "Bass Fishermen in Tennessee". Members of a specific interest blog share enough commonality that they get along and assist each other in a positive way.

I have posted this in another thread so there will be a higher likelihood for folks to read it.

I congratulate you on your involvement in that blog I could not find it under that name so I could not see how many visits it has had or how long it has been in existence. The Giles Free Speech Zone Blog has over 434,000 visits which verify its successfulness. The hope for this blog is also to have a commonality “our county“ and an opportunity to assist each other in a positive way. The only thing that prevents that from happening is simply unwillingness by some to stay on topic, research and accept facts, embrace the realities of life instead of the fantasies of feelings so often presented as reality. As a bass fisherman you must be aware of the many “miracle baits” that are presented each year, it’s only through the discussion by real fishermen that those “miracle baits” are exposed as nothing more than someone’s attempt to make a few dollars, it is no different with the politics of this county and other places. Grow an interest in developing a better fishing area and you will benefit from better fishing. Grow a more accountable, responsive, open government and we all benefit from a better place in which to live.

I am 7:33 and couldn't agree with you more.
I have asked many times why all this mess could not stop and was met with ridicule and called names. I think this so-called free speech blog needs to shut down immediately. It is not and never was a newspaper for people who don't read or listen to the radio. Some people just like to fuss. Others have had their minds poisoned by hatred and distrust, not seeing who the real source of the strife is.
I too had hopes for a better year for Giles County. It's sad.
