Another Freedom Bites The Dust
A second important vote was taken this morning in the Legislative Meeting this one will get much deeper into citizens pockets than a time change for the meetings.
Today in an act of moral cowardice Commissioners voted not to opt out of the new requirements by the state that will require a $350.00 new fee to be paid to the state for inspections of all new single and two family dwellings. A few months ago Mr. James Pillow with the state Commerce and Insurance Department came and met with the County Legislative Committee. In that meeting Mr. Pillow gave a very candid account of the results of taking back our tax money in the form of grants. The state requires that all new residential construction be inspected for environmental compliance. Right now that involves windows but will soon include almost every other area from roof material to water units used when flushing toilets. Currently the inspection cost $350.00 on a $150,000.00 house. Next year it will also include any additions containing 30 square feet or more. Of this fee $15.00 will stay in Giles County and the rest will go to Nashville.
Mr. Pillow explained that there are three options available to the county: 1) Do nothing and accept the situation as it has been implemented by the state. 2) Create our own program and enforce our own codes within the guidelines of the state. This could also be accomplished by contracting with the City of Pulaski's building program. 3) The county can opt out of the program by a 2/3 vote of the County Legislative Body. This would have to be re-voted on with each new election of commissioners. To opt out will not prevent the county receiving grants but it will reduce the score given counties by 15 points at the most. Currently 21 counties have opted out of the program and within Giles County the cities have opted out.
The committee voted unanimously to send the recommendation to opt out of the program to the full Commission. They also decided to hold community meetings to give the public an opportunity to address the issue.
Have any of you been to one of these meetings, so far only Commissioner Beech has held a formal meeting and mostly contractors were there and in favor of the fees and restrictions.
Every commissioner that spoke agreed that this was an encroachment into the rights of citizens, that it would be costly and that it was just the first step in a move to have every aspect of houses, additions, repairs and other buildings inspected for a fee. Yet ten commissioners voted to strip citizens of the right to control their own property and impose this new fee on the people.
Commissioner Campbell even went so far as to say if we opt out of this we probably won’t get the Hwy. 64 and I 65 projects completed.
Over and over commissioners complained about “being held hostage” by the state and forced to do this but few had the guts to stand tall and vote against it.

I was at that meeting and "moral cowards" are kind words compared to what some of them should have been called. I hope you watch the meeting on TV and see how strongly some spoke but how weakly they voted.

What now? What affect does the Commission vote have on the average citizen? Does the County now create a codes office since the Commission has decided not to opt out of the State program? By not opting out does Giles County now opt in?
Who will review plans, study proposals? I guess that will now fall onto the County employee who has been charged with code inforcement by the County Executive. Can you guess who that emp[loyee might be???? I know for a fact who that employee is and I an courious to see if anyone else has been paying attention. The employee is a man who is not the sharpest knife in the drawer. He is very loyal to the County as a whole and especially the County Executive. He hold numerous positions and, in my opinion is over his intelectual head.

To 7:52 This is my opinion on what next. As WAB stated it was said in the meeting that building codes and zoning go hand in hand. Get Ready cause here it comes. We have voted this sort of governmental meddling down before, but the all knowing commission seems to have forgotten that. It was stated that no citizen in this "town hall" meeting wanted a tax increase. Guess what, I don't either. My question is this, Were these citizens that were willing to opt in to this state mandated racket made aware that the ramifications of this means zoning is coming? This is also another government job that must be created because someone will have to handle these inspections, and we cant expect any current employees to do this unless of course there is a substantial raise involved. I hope I am wrong on this, but I am afraid not, and as I stated earlier this is my opinion.

Yes, I referred to some commissioners as "moral cowards" for that is exactly what a person is who verbally condemns then votes to support what they have just condemned.
We are already in the program the only options were to opt out and now we can't even do that. Rep. Bass supported this bill after the options were included, unfortunately he apparently didn't understand the underhanded measures that would be taken to make sure no one opted out. Even with these abusive measures 21 counties have opted out declaring it to be too intrusive.
While most citizens will not be directly penalized, unless they build a new house presently, they will be subjected to forthcoming regulations that are planned to be added in the future. As the inspections are increased to include more areas, with increased fees, eventually according to Mr. Pillow all houses that are sold will have to meet the standards imposed before they can be sold. That means if your house was not required to be inspected in the first years or if your house was built before this policy was adopted before you could sell that house it would have to be brought up to current standards. For example a house without approved energy efficient windows would have to have them installed before being sold. Toilets that fail to meet the flush requirements would have to be replaced, inadequate insulation would have to be improved. I can easily see a house that is valued at $50,000 requiring another $50,000 in improvements before it could be sold, and understand because you make $50,000 in improvements doesn't mean the house will sell for $100,000.
Another question that has been raised is will the county create their own inspection supervisor, with staff, and who will that person be? I personally do not believe it will be anyone currently working directly for the county but perhaps someone who will be given the job in return for favors and support to the County Executive.
This is not an uncommon practice as witnessed by actions of a school board member and the director.
This is a situation that will need watching closely.
I will take a shot at who would be selected to conduct and enforce building codes in Giles County. Since Mr. James Pillow is with the Department of Commerce and Insurance office of Fire Prevention and he is responsible for overseeing all code enforcement activities and inspectors; it stands to reason the Mr. Barry Whitt will be tasked to enforce building codes and conduct code enforcement inspections. Mr. Whitt is the Giles County Fire Marshall.
I can not believe that anyone would believe that Barry Whitt would consider being responsible for building code enforcement and inspections. He has enough problems trying to keep the Squad together.
It is interesting to note what this new inspection is all about. It's not about the structural integrity or code compliance of the wiring in a residence. Rather its main concern is "The state requires that all new residential construction be inspected for environmental compliance."
Now excuse me, but I'd really like to know exactly what that means? Because without real justification it appears to be just another slick new scheme by our state legislature in finding new streams of revenue to the state coffers.

Hey ...... does anyone remember when the Giles County Commission passed a resolution allowing certain properties to be covered by flood insurance?? Resolution was sponsored by Tommy Campbell I believe and was passed in 2003 or 2004. That resolution requires that all new constrcuting, regardless of where it is (flood zone area or not) must be presented to a County official who will review all plans and issue a building permit.
I bet that the majority of that Commission did not read the Tennessee/Federal law pertaining to that resolution. Guess what????? Giles County has building permit requirements and the current County government is just ignoring the law.

I never denied that I said I don't always know what's best to do. As I have explained before, what I said was in response to some smart remark made by one of you guys (perhaps you?) who accused me of thinking I always know best or that I know it all or something to that effect.

"I don't always know what's best to do" and "I rarely seem to know what's best" are worlds apart in their meaning.
Even you should be able to see the difference in those two statements and you certainly did since you changed the new statement to be less revealing of your overall abilities.
