Lawsuit Settled, Or Extortion Paid?
Yes, the newspaper reported that the lawsuit brought by Clay McAlister against the city of Pulaski, a police officer and Me has been settled. It was settled several months ago when the information was leaked from the courthouse and posters began writing on this blog about it.
Since Mr. McAlister has chosen, against his own request to keep the settlement from the public, to openly tell important parts I feel compelled to fill in the blanks.
Why does a thirty million dollar lawsuit dwindle down to the final settlement. When McAlister's attorney heard the arrogance of his expectations of special treatment, wreck under the influence of drugs and leaving the scene without a police report even being filled and the prior psychiatric problems, he started back peddling.
Yes, I paid McAlister. It was the exact same amount paid by Lt. Glossup and the city, less than $1,300.00.
Why did I pay? Because it was a matter of spending over twenty more thousand dollars in attorney fees or pay the $1,200.00 in extortion. The amount paid by all three defendants did not even cover the attorney fees paid by McAlister.
My attitude was firmly planted in fighting this extortion, even to the point of selling my 1964 Mustang to pay the extra $20,000.00 in attorney fees. It came down to paying the $1,200.00 or pay the $20,000.00 and try to live with a family that was not well pleased with the decision.
Oh, if there are doubts about anything I have written in this topic it can easily be proven by a simple reading of the transcript from witness statements.

Sounds like Barrett made a wise decision since there is such a big difference between paying 20,000 in attorney fees or pay 1200 in, I liked that term, extortion.
A few years back I had a problem with a fence that was moved. It was only a few feet from the original line but was about a acre for the full run of the fence. I had pictures of the old fence post holes and everyone agreed it was a open and shut case the only problem it was going to cost about thirty thousand just to get it to court the land certainly wasn't worth that much and I ended up just letting the thing go. If you don't have the money you just easy pickings for the crooks.

Will you be deleting the 5:48 post? Calling people names such as this guy did me and my mother and making threats of bodily harm are very serious matters. I fully expect that you will do the right thing.
This is a free speech blog, and nobody should have to put up with that just because he or she has an opinion about something.
The basher(s) on this blog have in past posts said things like 'nobody reads this',etc. trying to diminish efforts of people bringing to light some goings-on in this county. I had thought the McAlister thing was over and done with long ago. Seems like within the last week on one of the topics here someone brought the subject up----and lo and behold, an article appears in this week's paper about the dispensation of the case. Doesn't make any difference whose side you are on, both sides should have had their say printed.

I am the one who posted 4:20, and just wanted you to know that I did say you are the same man who is pushing for the charter. Isn't that correct? I think it is. Of course, you're not the only one, but you really are one of the major players, right? For that I was cursed and threatened. This is getting very serious.
Having said all that, I just want you to know that I want nothing further to do with the blog. I said that before but changed my mind. I won't make that mistake again.
I have done all in good conscience in opposiing the charter and in standing against those who seek to belittle and destroy decent and hard-working elected officials in this county. But now the charter issue is in the hands of the voters, and it occurs to me that I cannot stop the attacks on our elected officials. So what's the point of being here anymore? It's no longer my fight.

In closing, let me just say that you and I have some SERIOUS DISAGREEMENTS and OPPOSING VIEWS, and neither of us is likely to change the other. So it's a moot point. The proposed Giles County Charter may have failed during the August 2, 2012 election but 3 facts remain:
1) The proposed Charter for Giles County has been written;
2) The proposed Charter for Giles County can come before the electorate again in a future election;
3) The current failing approach for the financial management of Giles County remains in place.

How can tax money be left alone to draw interest when "We need to pay more to help them get out of this hole"? At home if your income doesn't cover your expenses shouldn't you cut back on spending instead of asking your friends, neighbors, relatives, etc. to pay for what could be non-essentials?
I feel all the people who voted for the Charter should boycott Russell's Signs because it is obvious that the "VOTE NO CHARTER" signs came from his business. I know I've done business with him in the past but will never again. I disagree with 6:31 comments in that people in this county are taxed to death and heaven knows there are no, and will not ever be, any jobs here. How much tax is enough, 50% or 75% of everybody's worth?
I'm sure Russell's Signs would have made vote yes charter signs for anyone who wanted to pay for them. After all, they are in the business of making signs.

Apparently you are since the post right above yours stated he had the right. There have been some questions in regards to tax dollars being used to help fund the no charter campaign. If this is true, which I hope it is not, my concern, as a citizens, is how much of our tax dollars went to printing no charter signs.

I did read back on another thread and saw Wanda defaming Barrett. Is that the same Wanda? In my opinion it seems to me that she may have started attacks on citizens of this community in other threads. So is Wanda Sue Garrett the same Wanda that attacked Barrett and said he was an embarrassment to his family.

I understand one's desire to take up for friends, but when one uses the descriptive terms that were in the Wanda posts, how can any one deny that they were defaming or meant to be?

I went back and re-read the thread topic, and I too now want to ask you that same question. Yes or no; are you accusing Clay McAlister of extortion?
It's the system that creates the extortion individuals just take advantage from time to time.
When a person says give me twenty dollars or I'll stand outside your business and tell everyone not to shop here is an easily identified act of extortion. On the other hand a person says I'll sue you unless you give me twenty dollars then they file the suit and say give me two hundred dollars and I'll drop the suit or you can pay five hundred dollars for an attorney and fees. This is a legal extortion but extortion none the less.

I read the paper this afternoon and looks like Barrett lowered the boom on McAlister who was revealed to be a big whiner and crybaby because he didn't get special treatment then had a tantrum with everyone who would listen.

I believe the truth of the matter is that Clay really only wanted Barrett to make a public apology for telling the lie about him. But pride and arrogance would not let that be. Do you have a brain? I mean...seriously? I read someone's post right here on this blog about Barrett's scathing comments someone read in last night's paper. I won't have my copy until this morning. I felt certain that he would have a rebuttal to Clay's piece in the paper. But Clay can also readdress the issue if need be, and I hope he will. I for one know for a fact that Clay never moved the signs because I saw the "crime scene" before and after the so-called crime was committed.

Barret's signs had been disappearing so he got his recorder and watched.
He saw a vehicle stop by them, maybe he knew who he was maybe he didn't know, but he recorded it and thought he had the person that had been moving his signs. Without looking at the video he went to the police. It turned out clay wasn't touching Barret's signs but moved Mrs Vanzant's sign. That is just what I think happen. No, I don't think his signs were disappearing out there on Mill Street. I know, because I traveled that road every single day to visit friends. I noticed. And I also know for a fact that Barrett's signs had not been moved on the nmorning or the afternoon when the so-called crime had been committed. It seems apparent to me that he lied and got caught in it.
Why would anyone defend that?
Honestly, 9:23, there is no possible way you could "know for a fact" unless you parked out there and watched. Simply driving by a few times a day proves nothing.

The signs were in the exact same position on the afternoon of the arrest as they were the morning prior to it. This I DO KNOW for a fact.

Again, this is what I know. I noticed Barrett's signs on both sides of those belonging to Mrs. Vanzant and Terry Harwell. They were in that position the morning of the arrest. Barrett's signs were in that same position following the arrest that afternoon. Mrs. Vanzant's sign had been moved out to where motorists could see it again. As for someone else taking down his signs, I don't know.
Did any of the signs belong to Clay? If not, what the hell was he even doing close to any of them.
Was he working for Janet, or was HE trying to stir up trouble. I believe that's an honest question.
I saw some crooked signs and even some laying over. It never once crossed my mind to stop and "adjust" them.

I am of the opinion that Clay was simply there to move Mrs. Vanzant's sign out to where it could be seen again by motorists. There were NO signs near hers when I first saw it situated near a small tree on Mill Street. Later on, I saw two of Barrett's signs erected on both sides of hers such that the viewing of her sign was obstructed. Whether Clay acted on his own or not is really not the point. I too was tempted to stop and move her sign out to where it could be seen again. Thank God, I didn't do that.

Yes, cg, but what business was that of Clay's. It wasn't his job to police the placement of the signs. Just another example of him sticking his nose where it didn't belong.
I believe his spontaneous actions caused him to get the hell beat out of him years ago, while in uniform. Sometimes he would be better off to mind his own business.
