S.336 - Marketplace Fairness Act of 2013 113th Congress (2013-2014)

Once again our Tennessee Senators have joined with the democrats to raise taxes on all citizens.
Senators Alexander and Corker both signed on with twenty two democrats as co-sponsors of  senate bill S.336 "Marketplace Fairness Act of 2013". While the title of this bill may sound innocuous it is far from it in reality. This bill opens the door very wide to impose sales taxes on all internet sales. Not only does it increase the burden of cost to the buyer but it also will require huge increases in cost to the seller which of course will be passed on to the buyer. With the added taxes, shipping and higher administrative costs you can say good-bye to not only better deals via the internet you can say good-bye to all transactions over the internet except with the very largest of companies.
Contact Sen. Alexander and Corker and tell them how you feel about this new tax they seek to impose on us. Then contact your Representative and ask them to vote against this destructive, repressive increase in taxes.

I agree with those that voted to pass this bill. I think local business should have more of an opportunity to be competitive. The prices will balance out locally once they aren't having to make more profit per item to make up for lost revenue from the internet.

Before the internet local merchants were getting outrageous prices and profits. This bill is not to make anything fair but to get more loot for the state. They need to spend less and let people enjoy a bit of their income.
Barrett is right the increases to do business will drive many out of business and the rest will pass the cost on to the buyer. In the long run everyone loses including the greedy local merchants.

Well Mr lawman why don't you explain the intricacies of economics and you could start with how a new increase in taxes will benefit anyone other than the government whose history is rather dismal when it comes to using taxpayer money wisely.
When you get to the need for highways please remember that highways are funded by the high taxes on fuel sales and those taxes have been used for everything from bicycle paths to museums and golf courses in hidden places.
Perhaps you will enlighten us with some wisdom that explains how the government putting people out of business in-order to increase the size of government increases the economy of a town, county or nation. For myself, I would appreciate some information as to how creating higher prices through restricted competition or restrictive regulations is helpful to the economy. Perhaps you ascribe to the obama and Jeffery Immelt theory of create jobs in China and Brazil and send money to every enemy while we continue to print money with diminishing value and accumulate debt at staggering levels?
Perhaps you believe federalizing huge sections of the economy like the auto, banking, housing and health industries while pouring billions into the pockets of friends and large donors through scam sciences and technologies benefits the economy and the individual.
Way back when I went to school my economics professor, not an assistant or student stand in, taught that the economic well being of a nation depended on providing something that others were willing to work and pay for, it was individual involvement not government redistribution that drove the economy.
Now when you take more money out of the general public's hands and places it in the hands of government you not only restrict growth of the economy you also severely restrict the freedom those individuals historically have enjoyed.

For starters, when someone can go online and pay $15 dollars less for a product, it puts the local guy out of business. He will increase his price to make up for lost profits in the hopes that he can keep his business while providing a better service or personal relationship with his customers. His employees are your neighbors, and possibly family members. If he loses his business, as many as 10-15 employees will be out of a job. In a small community, it will be hard to place those people into another job.

Leveling the playing field for internet companies increases the local guys business and provides him the revenue and ability to lower his prices to a level that is competitive. Your neighbors and family members keep their jobs and everybody wins. The company selling on the internet may lose a few sales, but will only have to cut 1-2 jobs in a warehouse in southern California. Most likely an illegal alien, which I'm sure you also despise. He or she will have another job making that same $10/hour tomorrow.


You talk about being a man of the community, but your ignorance of what it takes to manage one is easily read.

Assuming that I am a democrat and think Obama has any economic acumen is also ignorant. Sorry to use the term so much, but you seem to understand what it means lately. Your attitude toward everything indicates how long ago you were in school. You forget that it isn't all white Christian males in the workforce anymore. Don't let your far right wing beliefs get in the way of common sense.

Most of you are forgetting by not charging a sales tax for out of state transactions it allows a local merchant to be competitive in a state that does not have a sales tax. Local merchants need to be competitive in products and services. Take residents of Pulaski who have the highest sales tax in the state. Why should I have to charge an extra 10% than someone offering the same product in a non sales tax or lower sales tax area? This bill is idiotic.

I am confused. Last night I updated my computer virus software online. I paid taxes. A couple of weeks ago I updated a membership for software online and I paid taxes. If I order from Amazon I pay taxes. About the only time I don't pay taxes for orderin online is from Ebay. The department stores charge taxes for online purchases. Where is the change to be made?

To lawman, you pose some interesting questions with your absurd claims, from both your posts, on this topic. One major problem is your proposals are not directed at the real problems.
The first question I would ask is why would an item be $15.00 less on the internet than in a local business to begin with? Overhead is not that great a difference. This is the same argument used by liberals to prevent Wal-Mart from building a store in their communities. Commerce should not be about protecting some merchants but competition that drives each merchant to offer a better product and service. No local business is going out of business simply because they have to charge sales tax and an internet company doesn't, most of the time the tax difference is made up by the shipping charge. Because of competition internet companies are offering free shipping in order to get our business, what does the local merchant offer? Do local merchants go out of business because one of their competitors has a sale with 20% off? No they find a way to compete with a sale of their own. Any business person who succeeds does so by offering something better than everyone else.
Ask people why they shop at the big box stores and usually it’s about price and variety ask people why they shop in small home owned shops and it’s usually about service and uniqueness.
You are aware that there were large segments of people who were extremely opposed to automobiles because they would put buggy makers and whip makers and wheel makers, etc. out of work.
One of the reasons we currently have such high rates of unemployment today is the government picking and choosing which companies will prosper and which are to be closed. Couple that with the huge number of illegals competing for jobs and the number of over burdensome regulations and you have a very tough marketplace. Gone are the days when a merchant could mark up prices a hundred percent just because he was the only game in town.
You are aware that many internet sellers must collect sales taxes already and that you are responsible for paying Tennessee sales taxes on purchases you make outside the state, such as buying a shovel in Alabama while on a trip to Huntsville or Athens. The law states that if a seller has a physical presence in the state of the sale, “even if it’s over the internet”, that company must collect the sales tax for that state. It also states that if you make a purchase in a state where the sales tax is less than the state you reside in you are responsible for paying the state of your residence the difference. If that shovel cost you a hundred dollars in Alabama and the tax was 9%, because the rate is 10% here you owe Tennessee a dollar. Have you been paying it since you are so concerned about supporting your neighbors and state?

You say the seller over the internet may lose a few sales with this new tax, but you say nothing of the fact that the seller will have to employ more people just to keep up with the tax laws and rates in fifty different states.
You state your assurance that I despise illegal aliens but you show you own contempt in describing the circumstance of their labors in a California warehouse. I do not despise anyone but I am very much opposed to anyone breaking into my country then draining it of its resources. If you are here illegally you should be treated the same as if you were in a person’s home illegally.

I never assumed you were a democrat or a supporter of obama or his policies. What I did was simply look at your comments and respond, you are the one who made the Obama and democrat connection.

I agree, the whole tax thing is confusing.

The Supreme Court in 1992 declared that a state could not compel a seller to charge a sales tax on a buyer in a different state unless the seller has an actual physical presence in that state. An example is buying an item over the internet from Sears requires tax be collected because Sears has stores in Tennessee. I buy a number of things from "CJ Pony" in the Carolinas, they have no stores or distribution outlets in Tennessee so they do not collect a sales tax. Amazon is a different matter, currently they have a physical presence in Tennessee, a huge distribution center in Murfreesboro, thus they should collect a sales tax on items purchased by those in Tennessee but the state made a deal with them that exempted them from collecting taxes for several years, I think five but am not sure.
I would suggest if someone is collecting taxes that are not required to that you ask them why. I did this with a company named "Laural Mountain" and they cancelled the tax on my order.

So the big stores have the advantage of a lower price due to volume of sales, and no tax. Shipping costs won't balance that.

Knowing your attitude is as common knowledge in Giles County as knowing there are stars in the sky. You may need to recall your statement of ignorance on that one.

My statement means, it is easy to read comments from you and see you aren't capable of managing a community. Pretty simple.

The rest of your tiring rant contains very little substance. It is basically part of your old white man thinking. I do shop locally as often as possible. Saving a few dollars by purchasing online doesn't attract me. I had rather build relationships with local business owners for several different reasons. However, there are times when locals don't offer the products I desire, or they are incredibly overpriced. I have also found that it never hurts to negotiate on certain items.

The lawman may be able to dance but he can't seem to grasp the facts if he believes this is not raising a tax, "It isn't raising a tax, per say(SE)". Per se means not exactly or not clearly so please lawman explain how it's not an increase in taxes if it will bring in new money that is not being collected at this time. I'm sure you are aware that currently it is unlawful to collect sales taxes from sales in a different state where you have no physical presence and since that authorization does not exist currently to get that authorization would mean it is something new, would it not?
Now while you explain that you might also explain how the senate violated the Constitution by having such a vote. I'm sure one as informed as you will have no problem explaining why it was an illegal vote by the senate.

11:39 illegal means not legal or unlawful or against the law. Words have meaning 11:39 and knowing those meanings is what sets us apart. While the court did not rule in my favor it did admit that illegal activities had taken place but would not enforce a penalty on the lawbreaker. Basically it was turned into a traffic ticket that was dismissed.
As for the newly proposed internet tax by the senate there is no question the vote was taken illegally plain and simple the only real question is whether or not the law will be enforced.

Have you all noticed the businesses that are closing in Pulaski. Have you noticed the "For Rent" signs on buildings in and around the square. Pulaski is dying. The small business here cannot compete with the larger companies and internet sales. Brick and mortar businesses have to comply with the law and that is to collect sales tax. A percentage of that sales tax is returned to the city and county so that government can fix your roads and do business like that. I think it is only fair for internet sales to be taxed.

You still have to look at things from the consumer's stand point. No one will purchase something that doesn't really suit them just to be able to contribute toward keeping a local store open. As we all know, most of the families in Giles county shop at Cool Springs except for groceries and even then, many shop for groceries out of town in order to get better variety, prices and fresh items.

Well that's a crying shame to go out of town in order to get better variety, prices and fresh items. How much do you spend on gas doing that? All the grocery stores here in our towns have fresh produce and a good variety of food. Cool Springs doesn't need our help as far as sales tax goes but our schools in Giles County do. Shop local and help out. Keep our Ma and Pa stores open and keep our local businesses open so they can continue to keep employees. Most of the employees are local and pay their fair amount of taxes. Now I do agree that sometimes there are things you just cant find here. I understand that. But we need to at least try to shop local. Let's do our part to help keep Giles County alive and see if maybe it will grow. In the 1970's, I remember my mom would order from J.C. Penney because it was convenient. I understand convenieence of the internet but my mom would have to pay sales tax and pay shipping and handling. She didn't mind and wouldn't mind today paying the sales tax and shipping and handling from the internet for this is a convenience worth paying for and it doesn't take away anything from City and County government in order for them to provide us with the necessary services.

There is a lot of things I don't buy here because a lot of the people are the same ones that have held this county back protecting their high profits and screwing over the people.
Look at all the little places that have had the same thing happen to them over the years, Lynnville was a big place Campbellsville, Bunker Hill and other places was big places they refused to change and got left behind then they took the schools away and those places just dried up. They are still good places to live and the people for the most part are good people but you just can't hold people back and do things the same way for 200 years and not suffer for it.

1:24 Once upon a time Lynnville had many shops, it's own hotel, etc. It was a big community. Campbellsville even had an oil well drilled. You need to learn about the history of this county.

The same is true of Dellrose in Lincoln County. It was once a booming community with drug stores, shops, a car dealership, etc. etc. But it's not anyone's fault that it dried up. I know plenty about the history of Giles County. I also know that a small town isn't going to compete with larger grocery chains and retailers. Since people have to drive into the larger cities to work, it only makes sense for them to shop where the goods are less expensive. It would take all day to count the amount of businesses that have started and failed in Lynnville.

Did Dellrose have a railroad going through it years ago? Maybe it was a big place in the early 1900 and late 1800's. Prospect had a railroad and was bigger than Minor Hill many long years ago because Minor Hill didn't have a railroad.

That's correct! Now that he is in with the Finance Dept. he's gotten a lot smarter. He could do the job and most likely will be our next Finance Director, if anything happens to Ms. Moore. Then he can hire his wife to be the grant writer. That may be what Mrs. Vanzant has in mind anyway.

The video of the chili cook off, then the one of Vicki talking with the police made up my mind of them.
Also I'm not sure he should be working in the FD and still a commissioner.

Terry’s bragging, “I’m a commissioner, whatcha ya gonna do about it,” made my mind up about him. I believe Vicki even wished she hadn’t brought Terry into it. Wasn’t she the one said, “He’s got you on video?”

Then Vicki is talking with the police and saying Terry didn’t deliberately throw water on Hughes. He tripped. You can plainly see the video, no tripping.

That is my thoughts on the Harwells and had nothing to do with Barrett.
Get over it CG.

No, what I despise about Allen Barrett is the things he does and says that hurt people and not him personally. But I am not Will Rogers. I can't honestly say I never met a person I don't like, and neither can you. I don't like Allen Barrett because of the trouble he has caused out county. Terry wasn't bragging when he said what he did. I think he was angry and just plain fed up with the little group who have been trying to ruin him ever since he won his last run for commissioner in 7th District. And surely you are smart enough to understand that we ALL say things out of context when we are provoked. More than that, Mr. Harwell did what most any man worth his salt would do if his wife asked him to take care of a nuisance or a problem for her. I would. Wouldn't you?

Look, I haven't watched the video and don't plan on it now. All I am saying is that I would have come to the aid of my wife without questioning why. Wouldn't you? If not, why not? In addition to that, I have also said that Terry shouldn't have said what he did about being a commissioner, but he was angry, and we all sometimes say things without thinking when provoked. As for your hero, I don't think anybody has said that Barrett was behind the chili cook-off incident. I never said that. But I will go so far as to say that (my opinion) Barrett is responsible for a lot of the hatred we are seeing right here in Giles County. Why? It's because people like you are so easily swayed.
Finally Obama is NOT my president. He is ruining this country, and the sad thing is that most people don't seem to care. Who is behind it? Democrats? Muslim Brotherhood? Both? Who knows? We may not survive three more years of this guy.

cg you are such a dumb contradiction WAB and others have criticized and given solid reasons for that criticism,but you criticism them without giving so much as a speck of reasons. ok you don't like the guy but you have also said you don't really know him so how is that different than somebody criticizing you without knowing you. Can't argue with the facts. This year's deficit is only half of what it was in Bush's last year. I couldn't care less about parties as long as the guy is getting the job done. Getting a hold on this runaway deficit was always job 1 to me and he is now getting it done.
