Do People Selling Prepared Foods Have Health Department Approval?

This is a topic that has been requested by a reader.

Does the Health Department or any other governmental agency inspect, regulate and sanction the sell of all prepared foods sold in the county and state? 

The question arises from the fact that there are a number of sellers of prepared foods, (home canned goods, baked goods, smoked and barbecued meats, cheeses etc.) that would be required to have Health Department inspections were they in a store or restaurant.

It depends. Baked goods are supposed to come from an inspected kitchen. Canned goods - not sure if they come under regulations - but I'm always careful w/ other's processed foods. Prepared meats is a non-starter without regulatory approval. Raw dairy is illegal.

Them's are the laws ... and then there's common sense. Frankly, I'm a lot more worried about eating frozen pizzas & cocoa puffs than I am buying unprocessed milk/cheese. USDA-approval doesn't mean squat to me ... I'd rather know who prepared any food I'm purchasing. There's a huge movement toward buying local food ... and it's good for our local ag economy as well.

Anything prepared and sold for consumption comes under the health inspector. a lot operate without health permits. A lot of churches who have spaghetti suppers, pancake breakfasts, and regularly hold such type fundraisers are supposed to have health permits on their kitchens, but this is not enforced in this area for some reason.

What does it even matter? The real restaurants in this county are not inspected regularly. Here is a link for the scores for pulaski food establishments http://goo.gl/lOy2GT These have not been updated since late 2013 Is the inspector too lazy to enter the grades, or too lazy to do inspections?

Look at places that have a low routine score, then a followup that is higher, but the next routine inspection is low again. This means filth is a bad habit.

Either the county employee is getting paid off to have a blind eye, or nobody is paying attention that someone is not doing his job. That is enough to make me sick. I will eat at home.

As many people do. However, that is not the issue but the question was asked if those who sell BBQ, etc on the street or at a fund raising function have a health permit to sell? Unfortunately, I've been in some nasty homeowner kitchens over the years, add to that bad handling habits its no wonder people get gut ailments.

So y'all really believe a government bureaucrat, armed with a pen & a USDA checklist, fining those without appropriate permits, is our best means of providing healthy food? Yes, I've been in some dirty kitchens too ... but have you ever been in a USDA-approved chicken processing facility? Any idea of the fecal content in that Tyson chicken? USDA approval is a joke ... they're in business to put small guys OUT of business & to protect the interests of big-time producers.

I know I'm not addressing the question head-on, primarily because I don't think it's the right question. The best means to ensure safe food is to grow, harvest, & make it yourself. Next best is to purchase it from someone you know/trust. As for me, that ain't the government bureaucrat. Stupid laws aside, wouldn't you rather take bacon, a dozen eggs, and a quart of fresh milk from a reputable neighbor w/ a smokehouse over "Great Value" fare in the supermarket?

Even then if you grow organic some unhealthy things slip by whether it be veggies or meats, but most times for the majority of folks that is impossible. Believe the question is: do the people who cook BBQ, etc and sell to the public have a health permit and is it required?

Of course there is no way to insure perfection in food sources but there are attempts being made to cut down on the possible contaminations. An inspection is only as good as the inspector but if there isn't even an inspector there is no no quality control other than what is provided by the producer. Why is a restaurant or store required to be inspected by the state but those who regularly take orders for such things as cooked meats be allowed to operate without the inspections and in violation of state law? Certainly a church pot luck meal is a lot different from preparing meals to be sold for public consumption. I know that most larger churches with a kitchen that serves meals to the public is inspected.

The issue is, I believe, why should a person who opens a hot dog stand on the corner or sells chicken fingers in their store be required to meet certain sanitary conditions while a person who cooks Bar-B-Cue at home and delivers it to some organization not have to meet those same sanitary conditions?

10:41 I'll add to your post. It is my understanding that if say, a church or other organization that has passed health inspection, holds a fundraiser or whatever, they can only sell "in house" and not to the general public at large.

I agree with 8:28. Is the goal of the FDA to protect the citizens or is it to control small farmers and to continue collusion with Monsanto and other cronies in the big ag business.

Supporting local farming/ranching/food processing endeavors would help the local economy. In times of peril, it could mean the difference in famine or feast. And, the quality and freshness would be incomparable. Google the story, "Maine Town Declares Food Sovereignty"- food for thought!

I know you just pulled "Bubba's" out of a hat for your analogy, but all else aside, they are great. Not only do they have all their permits, but they keep their establishment clean enough to eat off of the floor if you were so inclined. Unfortunately, that is not the case with many eatery's hygiene. I have done electrical work at most restaurants around the county and atrocious does not begin to describe some of them. It certainly shortened my list of places to grab a meal. Some of these places can NOT be getting inspected or else the inspector is on the take. Careful where you eat.

Some one asked Barrett to start this thread, why does someone have such a vendetta against Barrett they want to change it?

I thought all places that sold food had to be inspected. There should be a grade on the wall for you to see what grade they got. When we go to a place to eat, we can't go in and check out the kitchen before eating. I've been to places where the dinning area wasn't clean, so got up and walked out.

At church dinners and family reunions, I'm picky at who's food I ate. I have a good friend, that's house is clean, but when she is cooking I have seen her take a spoon taste something, then after adding something use this same spoon to dip back in the food for another taste. Sorry I can't handle that.

I have always trusted restaurants and fast food that have been inspected, but I will not send food back to be redone. I just want eat it and not go back. I'm not a very trusting person and afraid of what they might do if returned. Have heard a few stories which could of been told in fun and not true, but so easy to put DOUBT in anyone's mind

Looks like Barrett has been raising hell at another meeting. Saw where he was wrong about Terry Harwell voting at a budget meeting.

Pertaining to the thread, Barrett is the kinda guy that gets his food spit on by everyone in the kitchen because he would probably send it back 3 times to get it just right.

I just read WKSR on the net.
I thought the commissioners had already voted for a wheel tax. Is that not right?
What are they waiting for, after the election?
The hospital fund is gone, wheel and property tax are going to have to be. Then next year they will have to go up because everything else is going to still be going up.

I don't know what people are going to do. I'm to old to ride a bicycle. Might be good for us.

To 7:44. Mr. Barrett was not wrong. The Tennessee code book that the commissioners go by states that if a person is already a commissioner and takes a job in the financial office he can not vote on things pertaining to money. If he is working in the financial office and then is elected to office as a commissioner he then is eligiable to vote on money matters. Know your facts before you start bashing some one.

Now as to the matter of my so called "outburst" at the Budget Committee. I simply raised my hand and the chairman Commissioner Greene recognized me to speak at which time I stated that I wanted to lodge a protest against Commissioner Harwell, who was sitting in for the missing Commissioner Coleman, voting on budgetary items in violation of state law. Commissioner Harwell then without being recognized angrily stated that he couldn't vote on the budget in the full commission but could in committees. This is all viewable on the video recording of the meeting. Commissioner Harwell was allowed to continue his illegal activity.

I placed the following comment on the WKSR website, "The only thing that one needs to do is simply read Tennessee Code Annotated 12-4-101 and the Tennessee Attorney General opinion No. 09-175 to know and understand that Commissioner Harwell is not authorized to vote on any budgetary items but even if re-elected will not be authorized to vote on budgetary items therefore the 7th district will remain under represented.
The problem is that the County Executive has not, to date, required her hand picked commissioner Mr. Harwell to be controlled by the laws of Tennessee".
This is not the first time this issue has arisen nor will it be the last as long as the County Executive continues to flaunt special treatment and violations of the law. Giles County deserves better.

Sale of foods prepared in "home-based kitchens" is regulated per T.C.A. 53-8-117.

After reviewing regulations given in T.C.A., Title 53, Chapter 8, the only shortfalls I've ever seen at these road side sales or benefit functions in meeting these regulations would be the product labeling requirement per TCA 53-8-117(d), and/or the home-based kitchen food preparation placard requirement per TCA 53-8-117(c).

So, in answer to your question Mr. Barrett - yes they do, in accordance with stipulations of Tennessee Code Annotated, Title 53, Chapter 8.

That is not true 12:58. If the home based business regularly prepares food for sale then they must have a health certified kitchen. Three bin sinks, separate mop sinks, regulated temperatures for storage and cooling of refrigerated products. If the home based business advertises, or any entity advertises the sale for consumption of prepared food they must be certified by the health department. This is what the health inspector, Keith Henshaw told me. But in Giles County it is enforced on some and not on others.

At the highway committee meeting, they did vote on a wheel tax in the committee meeting but that doesn't mean it will pass at the full commission where every one votes on it. It has to pass committee before it can go to full County Court.

Commissioner Pope is also in favor of the Wheel Tax. I wonder if he would be so in favor of it if he were charged for all his commercial vehicles at a much higher rate. Let's add an amendment to the proposed wheel tax which requires all commercial vehicles be charged in the $500 or more range. After all, his dump truck and trailers do a lot more damage to any of the roads than my car. Seems a small price to pay Tommy for the privilege of using the county roads for your business.

Look at the amount of taxes paid by the citizens. The taxes paid by the businessman come from the revenue generated by the customer. Commercial vehicles need to pay a substantially higher Wheel Tax if it is voted in. Do you actually think it's fair for a dump truck which generates revenue to pay the same tax as a personal vehicle. I think not. If I were in his shoes as you suggest, I would think twice about his Wheel Tax push because his days will be numbered as a Commissioner. People don't want it. Period. If there is some hidden agenda for his favoring of a Wheel Tax to generate revenue for the Highway Department then it will be exposed. I'm not sure how much work he does with his dumptruck for the county but there seems to be a conflict of interest.

The fact that is that these operations do not meet the definition of a "Food service establishment" or a "Retail food store".

Among the entire Code you need to pay particular attention to TCA 53-8-203 "Part definitions" Paragraphs (3) through (7); and,
53-8-117 "Sale of foods prepared in home-based kitchens" (3)(e).

And further, read TCA 53-8-203. Part definitions" Paragraphs (8)(A-B),(9)(A-H), and (13)(A-B).

Regardless, please read TCA 53-8-113, "Inspections".

Read the regulations, they are not very hard to understand and they are written in English.

The law states one can cater and prepare food from a home kitchen, with out a permit, as long as there is no significant market impact. However Mr. Henshaw informed me they are trained to enforce the health requirements if one advertises. I have watched as Mr. Henhaw has allowed others to advertise, prepare and distribute food without enforcement of health requirements.

The fact is it does not matter what the law states here in Giles County because you have arbitrary enforcement of those laws.

Let me say it again. My question was to Allen Barrett and not to you. But, in his defense I will have to admit that he did delete some filth in a recent post when someone, in a very derogatory way, referred to him as a homosexual. That post was quickly deleted. Don't you find it hypocritical that posts were never deleted wherein people were called names I'll not repeat here? And, as recent as yesterday, there was some pure filth on here, so don't say it's removed. I just want him to answer the question. It really looks bad on his part to allow such stuff.

Has anyone heard how the teachers and personnel were moved around and transferred without their knowledge or the knowledge of the pricipals? They received certified letters in the mail stating they had been moved for reasons no one knows except Cindy Young and Tim Webb. The county shcool board made a terrible mistake. Now the entire community is going to suffer. Come on public, speak out and attend the board meetings. The school system is being flushed down the toilet.

I do not read the blog on a minute by minute basis as you seem to do 6:36 but I try to delete any and all "filthy" language. I do not attempt to censor comments based on mildly offensive language as I do not have the capability to only remove individual words.
Please understand that what you or I may find offensive is not necessarily "filthy" language. If the Supreme Court can not define what is "FILTHY" why would you expect me to be able to unless you really have a much higher opinion of my abilities than you have expressed thus far.
As for your accusatory question i believe that the Tuesday 7:55 poster provided as clear and appropriate response as could I so I will leave you with that response.

That's a lie. Your problem with me is that I don't support people like Allen Barrett and others whom I feel would be a detriment to our county. That being said, people like me are ridiculed, called names, and falsely accused when our views differ from the thinking on this blog. What makes you folks think you have a right to do that and not expect rebuttal? Regardless, my support goes to Mr. Harwell and to Mrs. Vanzant. You may not know this, but this blog has won both of those two individuals a lot of votes. You may call it hearsay if you please, but the fact remains that it's true.
As for judging others, thank God I'm not the judge. But when one goes about calling himself a man of God and then doing things he should know are not getting the Lord's approval, I simply question it. I wonder about the hypocrisy and arrogance. That's only natural. And soul-winning is a term I hold near and dear to my heart. But wouldn't you agree that time could be better spent in that effort than in calling names, stirring up trouble, and the like?

It seems to me that trouble is trouble and that doing it to set things right is no different than doing it for the Lord. Isn't doing the right thing pleasing to the Lord? Paul was seen as a trouble maker because he was upsetting their gravy train the same way some are doing here in the county.
