County Commissions Trying To Kill Sunshine Law

This appeared in the Daily News Journal as an editorial on 10 November 2011. It alerts readers to a very serious attempt to weaken and destroy the State Open Meetings Law. Some Giles County Commissioners have already been in discussions supporting this proposal. While many aspects of the law are already ignored if the law is changed by this proposal there may as well be no Open Meetings Law.

"Public. Private. We often associate the first word with "government," the second with "business."

But when it comes to "government business," the first word should always apply. That's why a proposal by the president of the Tennessee County Commissioners Association to weaken the state's 37-year-old sunshine law must be stopped in its tracks.

Williamson County Commissioner Bob Barnwell has cooked up a wrong-headed proposal under which any number of members of a county commission, school board, or city council — up to a quorum — could meet and discuss public business. Public notice would only be given if a quorum of the body was present.

Bad idea. Horrible idea.

The people's business should be public, with few very specific exceptions. Yet we continue to have elected officials — those who've been granted the honor of representing the citizenry — searching for ways around the sunshine law so that public business can be conducted in the shadows and behind closed doors.

Conducting government business out in the open benefits not only the public but elected officials as well. Records are kept and maintained to hold everyone accountable. It gives credibility to the workings of government because it ensures that decisions are being made in the light of day for taxpayers to see for themselves, then determine whether those decisions are right, wrong or indifferent.

According to Frank Gibson, executive director of the Tennessee Coalition for Open Government, Barnwell is urging county commissions statewide to back his proposal with resolutions that ask their local state representatives and senators to support the measure when the General Assembly reconvenes in January. Barnwell has reportedly secured a sponsor.

Under the state's sunshine law, two or more members of a government body may not gather privately to "deliberate" toward a decision.

Contact your county commissioner today let them know that you want the public's business to remain just that."

Secrets have ruined this county and empowered the crooks that run it. If this passes Bass can kiss his chance of being county executive goodbye. This is just another power grab that will keep the people in the dark exactly where 10:21 and 10:58 want them.
We fought wars to prevent this kind of abuse of the people. Do we need another one?

I know firsthand business takes place outside of the meetings. Stand around outside the commission meeting room before a meeting and listen. Several times I have witnessed Campbell or Stoney trying to persuade someone to vote with them on one thing or another. Dont take my word for it, go hang out and experience it for yourself.

"The General Assembly hereby declares it to be the policy of this State that the formation of public policy and decisions is public business and shall not be conducted in secret."

Title 8, Chapter 44
(T.C.A. 8-44-101-201


The law says that any meeting is open when it consists of two or more members of a governing body empowered to deliberate toward a decision or a group making recommendations to a governing body.

And I spoke condescending to you because your childlike mentality evidently CAN'T comprehend what I posted. If two or more commissioners go out for lunch then they are PROHIBITED by STATE LAW from talking about any governmental business that may come before the body they were elected to serve on. If they choose to talk about sports or the weather or the stock market that is perfectly legal. If however they want to take me out to lunch I will be glad to go as long as county business stays out of the conversation, I try to follow the laws. By the way I am not Mr. Barrett, I do not feel he would be nearly as nice to you as I have been.

That is not what it means 3:52. It means that no two commissioners can hold a meeting and come to a conclusion for the entire body. It doesn't mean they can't discuss it outside of a meeting or on the phone. Get a grip on reality. I can't believe the way some of you try to spin this stuff. I don't know who started the rumor that Giles County wants it changed? I haven't heard anybody say that. This is coming from a commissioner in Williamson County that will probably try to get it passed in the State Legislature. Just like Barrett to mislead the readers on this blog into thinking that Giles County Commissioners are up to no good again. That is why he is called a liar.

From what I hear, this came up in last week's Budget Committee meeting and Stoney Jackson is sponsoring a resolution to support Barnwell's proposal to be presented to the Legislature, the resolution to be voted on in the Nov. commissioner's meeting. Any of our commissioners voting for this will be committing political suicide so I say go ahead and we will see how they come out in the next election. This would be as bad as a commissioner voting for a wheel tax in Giles county.

You are wrong to assume that they will committ political suicide. Stoney Jackson will be a commissioner in Minor Hill as long as he runs. I also know of several people that have pushed and voted for a wheel tax and have been commissioners for close to 20 years. Don't think that because you want to hold up progress in the county that all the rest of the citizens do. Just bet one thing, the candidate you stand behind (allen barrett) will never be elected.

It's very easy to see if, as has been claimed, I lied on this issue just attend the Commission Meeting and see if this matter is brought up.
There is no question that it was discussed in the Budget Meeting last week and the same people who have violated the open meetings the most are the ones who are now pushing to do away with it, and make no mistake if the law is changed as proposed that will be the end of open meetings where real issues are discussed in this state.

8:31PM Thur. and 7 AM Fri. have made absurd claims that I am a liar this is the perfect opportunity to actually see who's credibility is supportable. If this is not an issue being discussed and considered by commissioners then I am a liar, on the other hand if it is an issue being discussed and considered 8:31PM and 7:00AM have revealed themselves as liars.
I have had a number of commissioners call and tell me about the conversation at last weeks Budget Committee. While Commissioner Jackson is proposing the resolution he has several supporters on the Commission including the County Executive.
It is very important to watch who votes for this move to create a more secret government.
It is our tax money paying the salary and expenses of CTAS and its officials pushing this absurdity.

Why did Vanzant who is supposed to administer the laws on behalf of Giles county citizens, not insist this resolution go through the proper channels, which would be the county Legislative Committee.

2nd 8:18 why do people like you lie so much on here. There are already laws in place to deal with people that cause a disturbance. disturbing the peace and disturbing a public meeting. If Mr. Barrett did the things you say I am sure Mrs. Vanzant would jump at the chance to have Mr. Barrett arrested. But the fact is he does not do the things you accuse him of and when they tried to have him brought up on charges for disturbing a meeting the jury found in favor of him.

Our government officials as well as other politicians do not believe the public should have input once they are elected. This is really what is wrong with our country. Inadequate public officials that are incapable of representing the people as a whole and look for every way to silence the people so they may push through their personal agendas that benefit them, their friends and family.

If Mr. Barrett was all the things he's said to be and has done all the things he is claimed to have done how could he have any following? If his following has fallen off like has been claimed for continue to fear him so much.
The truth is more powerful than any one person Mr. Barrett has told the truth and some can't stand it so they try to destroy him instead of the things he says.
I think Mr. Barrett made it very clear in his 7:37 response to 8:31 either Mr Barrett or the anonymous coward that continues to attack him is a liar and that will be revealed
by whether this issue is being discussed by commissioners or not.
By the posts that followed Mr. Barrett's claim I already see that many people are aware of this issue and it is being discussed by the commissioners.

Mr. Barrett in my opinion has done more good for this county that any other single person in the past ten years. He has forced officials to hold open meetings and allow comment from the public something that was never done before.
He has prevented the cover up of bad behavior and illegal activities by some officials. He has fought for this county and the betterment of its people. Mr.Barrett in my opinion is a hero.

On 10 November in an 8:31 post I was called a liar because I had posted that the Commissioners were discussing and considering a vote to ask the state to change the "open Meetings Law". The writer did not post it as an opinion but as an outright claim based on his personal information and knowledge.
On 11 Nov. at 7:37 I posted a rebuttal to the absurd charge and challenged everyone to simple watch what the commissioners did at their next meeting and decide whose words had been lies.
The agenda for the commission meeting has been released, posted and announced on WKSR and right there in the agenda is the information that the anonymous accuser totally denied. The evidence is clear and the anonymous poster has been revealed as the liar.
Will there be an apology, I doubt it but what I don't doubt is that same person will post again with similar lies while claiming to be someone else. It was clear who the anonymous poster is and on what level his credibility rest.

Commissioners are expected to express their support for legislation that would amend Title-8, Chapter-44 to subject governing bodies to the same Open Meeting Act that the General Assembly is subjected to and approve the Giles County Debt Management and Fund Balance Policy.

fabricator, fabulist, prevaricator, storyteller. Just what word would you use to describe the behavior of one who intentionally tells lies and make it clear as to just what you mean?

I am not intolerant of those who think I lied but I certainly am intolerant of those who claim that I lied and offer no evidence to support such a claim. My 11:48 response was to the person who "stated emphatically that I lied" I simply proved that the real liar involved in that claim was the anonymous coward that stated I had lied and the proof of his lie was made clear by the agenda for the next Commission meeting and the posting on WKSR website.
While I wasn't particularly concerned with impressing you by using the dictionary I would offer you the same opportunity, learn to read and apply a dictionary, the Bible and the US Constitution and you too will be impressive.

OK So it is confirmed that Giles Co commissioners WILL be discussing their support of a motion to be put before the State Legislature at their upcoming Nov. meeting .
The proposal WILL reduce the effect of the State's 'Open meetings Law' .
You like that idea ? Commissioners WILL discuss YOUR business in private to determine how to maximise benefit to themselves , relatives and friends .Just as they have done here for over 200 yrs.
Do you plan to attend the meeting ?
Have you TOLD your commissioners what YOU think about this motion ?
Will you be at the commissioners meeting ?
Will you get VanZant's permission and SPEAK against it at that meeting ?
If you didnt answer 'yes' to any of the above then you're as much of an ostrich as your neighbor AND YOU WILL GET WHAT YOU DESERVE .

The enabler called Barrett a liar, that it was just a rumor, that commissioners had no desire to change the open meetings law, that Barrett was trying to stir up trouble.

Barrett told the enabler that he was not a liar and he would prove it. Barrett challenged the enabler and everyone else to watch what the commissioners did in their next meeting, if the commissioners did not discuss changing the open meetings law then he would be a liar but if they did discuss changing the open meetings law then everyone would know that the enabler was the liar.
WKSR announced it, the paper reported it, the agenda list it and now everyone knows the enabler has proven himself/herself to be a liar.
Once more Barrett is vindicated and the enabler is proven to have no credibility.

Of course Commissioners meet in private to discuss County business. These days they can do that by having a conference call and not be physically near each other and therefore not be in conflict with the State Sunshine Law. What really matters is allowing the average citizen to voice their approval or disapproval regarding matters that are being discussed. The problem is that there are Commissioners who refuse to listen to any descent no matter the source. There are also Commissioners who will listen to any citizen. Whether or not a Commissioner agrees with what is being said is not the issue. If Commissioners want to cease the hecklers and minimize the impact of the vocal few, just allow them to speak in a public forum. Limit the time allowed and sit there and take it. That does not mean that you have to “listen”. I bet that there are many students in our school system that sit in class, with their mouths shut, staring ahead, being polite and absorbing nothing that is being presented by the teacher.
Would it not be something if the Chairman of the Commission opened the floor for public discussion? All they would have to do is ask “who wishes to speak?” Count the hands that have been raised, divide that number into 10-15 minutes and that would be the time allowed per speaker. The citizens get up and speak. The Commissioners could either listen or daydream. The Sheriff would enforce the speaker’s time limit. It would also be nice to allow this public forum prior to the Commission voting on any matter brought before them.
I also agree that there are normally very few citizens who attend government meetings (Nov 16, 5:59 PM is correct). WHY? Possibly it is because all meetings (with very, very few exceptions) are held during “normal” working hours and very few citizens can get off work to attend. Yes it is very comfortable to hold government meetings during the day, especially for those government officials who are being paid. To hold meetings after normal working hours would impose a burden upon our government officials and this would be a great inconvenience. But WAIT! Are not our government officials working for the common citizen? Should not they do what is convenient for the average citizen?

There a lot of people in the county that are more knowledgable than some of our commissioners. The old saying of two heads are better than one is so true. I am not downing our commissioners.

We have a lot of good commissioners and then a few they think they know best and will not listen to anyone.
I found that out several years ago and you bet I didn't vote for him and told how he acted to others. Moral of story he got beat next election. All I wanted was please keep up our beautiful courthouse.
He got out ruled and it was fixed.

Not wishing to argue, but if elected officials discuss over telephone, by e-mail or whatever, they are indeed breaking the current law.

There is already a written law that says the county executive sets the amount of time a citizen can speak, usually 3 - 5 minutes. I do not know of anyone who has raised their voice in a meeting unless an elected official has already gotten loud to that person, or provoked them with unnecessary remarks. The person who is constantly stating people are members of a "Cave" for whatever that means, is really making pretty stupid and untrue remarks. This is done to provoke dialogue on this blog that steers people away from the topic at hand.

Most of the meetings I attend myself so information is first hand, nothing I write on here is information that has not been verified by at least two sources. There are a number of Commissioners and County workers who are trying to do the right thing for and by the people, they have no problem with openness of meetings, but then there are a few who simply can not stand any opinion to be heard but their own, and they operate in secret in the same way some use anonymous to post cowardly "rumors" on here.
Not only are there mostly good hard working people on the Commission and in the county workforce there are many who as every bit as disgusted with the behavior of some as I am.
8:14 posted good comments and I am in agreement. The only exception I have is small and to the matter of believing "What really matters is allowing the average citizen to voice their approval or disapproval...". As important as hearing from the public is, violating written law is just as egregious. State and local leadership suffers from the same problem as does the national congress, they are not highly trusted and every secret meeting only validates that lack of trust.

At 2:47AM I was enjoying a very peaceful sleep which I continued until about 7:15 am. Thank you for considering me. The question I have for 7:21 is why do you feel everyone who writes anything remotely supportive of me has to be me? You have said many times that I am too arrogant to post anonymously, if that or any other anonymous post were written by me would that not make you wrong again? Do you ever think through your statements? Another question that puzzles me is why do you consider yourself to be the only enabler referred to on this blog. As has been stated by many before "enabler" may be a proper term for you but it obviously is not your proper name so why continue responding to it when you know it, or claim it, does not apply to you?

To Fleet Fox, Did it occur to you than some commissioners don't get phone calls because people have just given up on trying to contact them? There are some commissioners who simply will not answer their phone or return calls when messages are left. When a commissioner verbally attacks and humiliates a very senior female citizen to the point of making her cry they are not representing "the people".

How many times do you think Dr. King heard that same statement? Slave owners declared their slaves "were happy". causing all the trouble, "the good ones are happy with the way things are". I didn't buy it then and I certainly don't buy it now. When you consider the large number of people in this county without a job, who have lost their house, are having to depend on other family members for a place to stay and are having to ask for charity for the first time in their lives they are not "mostly happy". When people are having to pay exorbitant taxes to a government where there is little to no accountability people aren't "mostly happy". Working all the overtime you can just to scrap by then seeing many whose salaries your help work 35 hours and get paid for 40 hours, the people are not "mostly happy".

Yes, I too agree with you that Newt Gingrich is probably the smartest of the Republican candidates, but I worry that he might not be able to beat obama. As a former Republican but still conservative at heart, he will get my vote.

Newt is the only real candidate that I see on the stage. I got caught up in the hype of Herman Cain for a bit, but he doesn't have enough experience to be there. Newt knows the government inside and out. He knows foreign policy and his ideas align most with mine.

I think he would destroy Obama in the general election because he will make him look like a child in a debate. Most of this country is ready to vote for any person that is running against Obama.

Newt stood up in the Republican debates and made a statement contrary to the Constitution and how our government is to deal with treasonous acts and the statement is made he knows the government inside and out.

He may know the government but there is a lot to be desired for his knowledge of the Constitution.

We need some one who respects the Constitution, is knowledgeable of the Constitution and it's Amendments, and has a lustful enthusiasm for defending each and every right of all citizens of the U.S. and Newt is far from that.

Our Constitution when upheld by our government and the people is the most powerful weapon in the world for keeping this country strong, competitive and free.

In addition a capitalistic free market economy made us a world leader and as governments continue unnecessary regulation, additional taxation, and spending taxpayer money to bail out companies that would have normally failed we will continue to weaken. But Congress will continue to see their personal portfolios increase in value by investing in those companies they used taxpayer money to bail out.

The press is going to eat them all up. I have watched the media attack every candidate that becomes the frontrunner. Newt is fully aware of the constitution. I guarantee you that he has forgotten more about the history of this nation and what our founders laid out for us to become a great nation than we will ever learn.

The only thing he said that would go against the constitution is that we should treat American citizens like a terrorist when they carry out acts of war against the United States. If you think that doesn't deserve an amendement to the constitution to do just that, you deserve another 4 years of Obama. Thinking like you do would classify you as a liberal. Anybody that hates America enough to side with terrorists and is a threat to us and our neighbors deserves to die.

Newt was the Speaker of The House when we had 4 consecutive years of balanced budgets. Clinton got respect as POTUS because of people like Newt leading the way. I for one think that every one should have fair treatment and protected right to face their accusers in a court of law. Their is no need for an Amendment unless you want to live under a dictatorship.

As a former Republican, I'd like to see a thread started on how certain sleazeball GOP politicians are kicking our teachers and the TEA. This is one of the main reasons I decided to leave the party. Let's vote them out at the earliest possible opportunity, even if we have to vote for a Democrat.
What they are doing is wrong, and our teachers are suffering because of it. Ultimately, our children will become the real victims when quality teachers become scarce.

There is a big difference in thinking that the Constitution should be changed and ignoring the Constitution. A terrorist who is a citizen of this country IS covered by our Constitution. Should they be dealt with differently I think so, but the rule of law must be upheld or we all loose. People who are not citizens and caught in terrorist activities should have no right other than those afforded any saboteur, spy during war time.

As for how teachers are being mistreated by the state administration please give some specifics. Just saying they are being bullied and abused doesn't really say much. What specifically has been done to teachers in Tennessee that you disagree with?

I have read your attacks on people with differing opinions. You were even petty enough to try to elevate yourself with an attack on a simple mistake in spelling, even though your grammar is riddled with mistakes and misuse of words, but now the Constitution is important to you. I see no one else should be afforded Constitutional rights except you. You make statements in contrary to how the Constitution reads concerning the rights of citizens accused of treason and now try to use the Constitution as a shield when it suits you.

Do you really want me to go through and correct all your mistakes. I made a few notes for you.

Other people have tried to explain it to you so I will re post what Frank said, which is in essence what I have been saying.

There is a big difference in thinking that the Constitution should be changed and ignoring the Constitution. A terrorist who is a citizen of this country IS covered by our Constitution. Should they be dealt with differently I think so, but the rule of law must be upheld or we all loose. People who are not citizens and caught in terrorist activities should have no right other than those afforded any saboteur, spy during war time.

You do not understand that the Constitution is here to protect all citizens, especially stupid people like you, and intelligent people do not want people like you, who desire to take away the rights we have that protect us from an oppressive government. Sorry but the Constitution is a take it all deal.

You stated, "I said that people that commit terrorists acts against the US while working with terrorists groups aren't important to me." (I think you meant are but who knows with you.)How are these people found guilty? Not by proper trial as laid out in the Constitution if you have your way.

Our system is built with checks and balances and what I am defending is an American citizen's rights that is allegedly a terrorist and because the Constitution deals with alleged or accused terrorists why not follow the law of the land. The reason we have written laws is to keep us free from arbitrary rule of our government officials. -(and if you are going to continue the back and forth over grammar please learn how and where the word that is properly used)

Yeah, you make statements that date back to the 1700's when the world was a totally different place. They also have nothing to do with the danger that is knocking on our door today. We were given the right to amend the constitution because our forefathers knew that times would change and we would face different challenges. At one time men were allowed to settle differences with pistols in the street. I think we have gotten past that.

You and your alter- ego Frank need to come up with something better than a few quotes and name-calling. (along with all your other names that you post under on this blog) I don't think an intelligent person resorts to calling someone stupid over an opinion.

First of all I do not know anything about Frank except he makes good sense. But I do call it as I see it and you have provided no proof to the contrary. In fact you ignore facts and follow up with another stupid opinion.

Second the Constitution was penned in the 1700's and is as instrumental in protecting our rights as citizens today as it was in the 1700's.

Third, there are provisions in the Constitution that allows for change of the document because the authors considered the changing times, technologies and changing climate of the World. Remember in the 1700's our enemies were at every border and on our soil but the peoples rights were still important.

You state you don't trust court systems to rule correctly? But you trust a panel of government bureaucrats to make decisions concerning American citizens lives based on information reported to them from the other side of the world and without defense. Much of the information provided by intelligence agencies comes from other countries or contract employees.

Maybe you are just anti-American. You write like you are.

Read this article in today's news to see how infallible these spy agencies are that gather the information. Our own government says they are careless and lazy. But you go ahead and waive your Constitutional rights, as for me I claim all rights protected.

I understand he threatned her with not helping Tourism next year. He also wanted to know why she schedled a Legislative meeting for next week. I must be the stupid one in this thing for responding to such absurd charges.
My name is Frank and I posted two comments under this topic and neither called anyone names or made reference to the intelligence of anyone.

I made a statement in response to what I considered incomplete thoughts about the U.S. Constitution and asked some questions for specifics about how teachers were being treated so badly by the officials in Nashville. I got no specifics about the teachers. I did get a response about the Constitution comment.

I don't know Fleet Fox, Deanna, Enabler or any of the other names that have been mentioned and I certainly am not any of them.
I do resent being accused of things I have not done and would greatly appreciate if the accuser would state what I said that was wrong, objectionable or belittling to them. If you can't tell me what I said was so wrong please do not reference me with others you believe have wronged you.

Criminal activity has been admitted so why would you not want to get such a person off the streets? Or is that person just lying about committing criminal activity? Any way the person seems to have something very personal against the person they claim to have under surveillance so it would be better to have the authorities look into it rather than wait till the alleged computer programmer snaps and does something awful.

The county Christmas party is not funded with public monies, and barrett and the enablers of strife were NOT invited. If you don't believe that, call and ask Mrs. Vanzant or any of the commissioners, and please stop trying to stir up trouble. By the way, I am the one that lie was told on that I enable wrongdoings, and we both know who told it.
Now, as for Tommy Pollard, you need to just give it up. I have the utmost respect for Tommy, and you are way off base.

I keep hearing you all try to defend any words that may have not been so postitive about Tommy Pollard, but the fact remains that everytime I have heard him speak at meetings he comes across as uneducated. The not being able to tie his shoe remark was off-color but he is like several of the other commissioners, they don't need to be making decisions for the county. You can't not vote for something the county needs just because it may hurt a few feelings. That is why the county is in the shape it's in.

10:20 Mr educated one, the commissioners have been made up of farmers and other no college graduates over the years and they did a better job of running the county than now.

I don't know all the commissioners but do know Bill Holt has a college degree, how many more do?

How dare you look down on anyone that don't have the education you do.

Any one may be on top of the world know, but anything could happen and they couldn't send their child to college.

It's 11:57 again. I don't know Tommy Pollard or how he talks, but someone being so much smarter than anyone else and looks down on them gets to me just like when Barrett says something about the elected officials gets to the Christian gentleman.
