Letter From MTAS Legal Consultant States Actions Of City Council Are Beyond Their Authority

MTAS is the Municipal Technical Assistance Service established by the state to help municipalities and to which those municipalities must pay membership dues.

Re: Ability of city to regulate sales of products containing ephedrine
The question has been raised of whether a city may regulate the sale of ephedrine, by requiring a prescription in order to purchase the over the counter drug. Products containing ephedrine are being purchased in large quantities by persons operating illegal methamphetamine labs.
Ephedrine is a non-prescription, over the counter drug which is regulated by the U.S. Food and Drug Administration. Title 21 of the United States Code “National Uniformity for Nonprescription Drugs,” contains the following language, which preempts any local regulation of non-prescription drug products:
no State or political subdivision of a State may establish or continue in effect any requirement--
(1) that relates to the regulation of a drug that is not subject to the requirements of section 353(b)(1) or 353(f)(1)(A) of this title[this refers to the section governing prescription drugs]; and
(2) that is different from or in addition to, or that is otherwise not identical with, a requirement under this chapter, the Poison Prevention Packaging Act of 1970 (15 U.S.C. 1471 et seq.), or the Fair Packaging and Labeling Act (15 U.S.C. 1451 et seq.).
21 U.S.C.A. § 379r (West)[emphasis added]
This language means that a city may not impose any regulations on sales of non-prescription drugs, or at least no regulations that differ from the federal regulations imposed by the FDA.
If you review the further language of 21 U.S.C.A. § 379, you will note that a political subdivision may make application to the Secretary of the FDA for permission to impose additional regulations. The Secretary may grant the application if three conditions in subsection (b)(1) are met. Although public health and safety is a concern for which this subsection states such permission may be granted, the measure cannot have an adverse impact on interstate commerce. 21CFR§379(b)(1). I have searched the Federal Register for any record of a successful application for exception to the operation of this regulation, and found nothing. This leads me to conclude that exception to this regulation is rarely, if ever, granted.
In my opinion, cities may not impose any additional regulations on the sale of products containing ephedrine, and may not require that persons buying products containing ephedrine have prescriptions. If a city is willing to invest a lot of time and money, an application may be made to the Secretary of the FDA for permission to pass an ordinance containing such a regulation, but I
am very doubtful that such an attempt will be successful.

Is it jealousy that causes you to dislike obama or his policies or is it because you can see how wrong and destructive they are? I strongly disagree with your assessment of what's going on here at the local level. It's not envy or jealousy that causes those like me to stand opposed to Obama and what he is doing to the nation. On the slight chance you might be referring to my not capitalizing the initials cg, I would be surprised that even you in your most arrogant pose would take exception to something that petty as cg is not exclusively a reference to any particular identification.

I am surrounded by friends and family who care about my life. Enabler is the lie that Allen Barrett told on me simply because he couldn't accept the fact that I as a Christian would never willfully go along with wrongdoings. He may be able to do that, but I can't. I lost my respect for Mr. Jackson when I found out he allowed someone else to walk the plank for him. That's how it appears. I know nothing about the hospital money and never defended or condemned Mrs. Vanzant on that. My daughter doesn't even live in Giles County, she has a full time job that carries a great deal of responsibility that requires even greater concentration and she is a very active member of her church family. She has raised two wonderful children, inspite of the incredible hardships endured from having no support from their dad. I am very proud of her and my son.

No, my daughter, son or any other immediate family member has nor has ever had a drug problem to include the use of alcohol and tobacco products.
I have every confidence, nor have I even considered the possibility that CG is the writer of such vile lies as have been posted about my family. I am very disappointed in the lack of his understanding and differentiation between a public official who takes an action that opens the door for humorous comments, being the only male to attend an all female event, and the outrageous filth that has been leveled at a private citizen who has absolutely no involvement with anything in Giles County. It takes a very small person to attack a child in order to get at their parent. So while CG and I may not see things the same I have no doubts such behavior is far beneath him.
I do have a very good line on the scum poster, it seems a thousand dollars is a nice incentive along with the fact that even their friends were disgusted by the actions of this individual poster. So dr you are in the spotlight and the beam is becoming more focused.

I just read in the paper where the Republican Party now wants a primary to be held at an approximate cost TO THE TAXPAYERS of $27,000. Now isn't that a brilliant idea? It will probably spell and end to the Republican Party in Giles County once the voters see who is going to cost them that much money. As a conservative, I just do not understand their foolish reasoning. I wouldn't want anything to do with this or with the GOP as we know it in Giles County. This is a terrible mistake if it goes forward. The Democrats will be the big winners in this.

I just read the two letters to the editor in this week's paper concerning a proposed Republican Primary. When did the local Republican Party meet to discuss this? I'd heard nothing about it until today.
Although, as a conservative, I strongly disagree with Democratic views on the taking of innocent life (abortion), gay marriage, big government and more taxes, etcetera, I would have to side with Cheri Thomas and NOT Gayle Jones on this issue. If the Republican Party proceeds with this foolishness, I am convinced that the GOP will disappear in Giles County for a very long time, especially when taxpayers find out who is costing them thousands of dollars NEEDLESSLY!
I would encourage Giles County voters, Democrat and Republican alike, to call Gayle Jones and others of her group and say NO! Is it any wonder why people vote Democratic...and I hate to admit that in view of many of the things they stand for.

Well you guessed wrong as usual 9:02. Mrs Jones is a very smart involved patriot and there is a great need to identify those who would support the radical party line of the democrats but I do not support a referendum that will cost the taxpayers so much money.
With so many republicans unknowingly supporting democrats it has become almost impossible to get the county and the state set on the right track. I believe that every candidate should be required to declare on the ballot which party they are aligned with. I strongly believe that a convention would serve this effort more productively.

A Republican primary at a cost of $27,000 to Giles County taxpayers is not consistent with my conservative beliefs. If this goes forward, count on taxpayers to vote every single one of them out of office. I think I and my family voted for every current office holder at the court house. If any of them declare a party though we will not give them a single vote and will campaign for their opponent. Local office holders should be independent of party labels.

Now if the election is at two different times how will they know if you voted for the one you thought would be the easiest for your man/woman to beat; then vote in the other election too. Just wondering why they want separate elections.

If you have 5 Republicans and 5 Democrats running for Register of Deeds or what ever, put all 10 names down and say you can only vote for one. If the D and R is needed by the name where this D or R nut has to know which party they belong for before vote for them.

When I ran for office, there were women who came from Sumner County, Chattanooga, Memphis. They put on the T-shirt, and we turned them loose in our neighborhoods. It’s effective, and together we can do it, but that’s the key word. Together. Physically and financially together.”

I guess it is alright for the Democratic candidates to use Democrats from other counties to come in and campaign as though they are locals to try to get democrats elected but when the Republicans ask for what is legally a right the moaning starts. Sort of like one Mayor candidate that thought Martin students that have a right to vote in local elections should be banned but gets non locals to help with her campaign.

Seems like you may be going over the edge. 6:16 appeared to be directing everyone to the post where you apologized so that readers could lighten up on you about not capping Allen's name. What did you do? You called him a troublemaker. Further proof that you seldom see the content of the comments on here. If it doesn't fit into your preconceived idea that everyone is against you, you simply "translate" it into something that does. I don't think you will make it much longer.

1:08 I think everyone should have to get a number or name to post on any blog so we could see which post is which. Then no one would be accusing the wrong person for a post they didn't post. I don't know it can be done, but wish it could and anytime anyone post their number or name would come up, but the real person would stay anonymous. Like 1, 2, 30, or Tom, Dick, Harry or what ever.
I like to read the blog and get confused at who posted what.

I've been reading other blogs and it seem the same stupid thing goes on there. I don't think anyone has to watch a blog 24/7, so how can any post be stopped. They can be deleted but it could be several days before the blog master see it. I've seen a few things on this blog that stayed up long enough for me to read it before being deleted then again I see where one has been deleted and wonder what was posted.

Yes, I agree with you. I've seen some really malicious things said on this blog about people like Ray Lanier, Allen Barrett, the Prouds, and others. This should NEVER be. That's serious, but to threaten someone just because his or her whose views are not aligned with a small faction of readers is almost as bad.

I think the threat cg is referring to is being outed. Someone evidently found out cg's identity and told him if he didn't stop giving in to his obsession with hijacking threads and turning them into all things Barrett, they would reveal who he was. Personally, I'm sick of hearing about how Barrett lied on him and all his other "pot calling the kettle black" rhetoric. Oh well, I guess we'll see.

Intimidation, bullying, and censorship do not define free speech. And on this blog, it now becomes apparent that one is free to speak his mind as long as what he has to say is in line with the general consensus of two or three people. If and when a writer goes against their way of thinking, he is called names, falsely accused, and threatened in some way to be silent. More importantly, it appears that the person in charge of this blog looks the other way. Disgusting.
That being said, I've come to a painful realization. I can no longer be a part of the conversation, because I cannot afford to have someone deliberately hurt my family. And if that person "exposed" me, I'm not sure I could find out who he is. So, the obvious choice looms large; I must sit down and shut up. The threat worked.
In a way, this seems a bit cathartic...like a punch in the nose. But I cannot go on, not knowing how low this person might stoop. And those one or two people who called me a host of names and did everything they could to discredit anything I said will now have to either find someone else to pick on or decide on a hobby. The intimidation and coercion worked! So much for free speech at Giles Free Speech Zone. Even the name of this blog is total hypocrisy!
Just remember that God knows who you are! Have fun.

Yes, that thought already occurred to me. I think these people are very dangerous and always felt that someone needed to stand up to them. I can't do it anymore. I don't agree that all this was done to stop opposing opinions. This forum calls for and welcomes different points of view. What is unwelcome, however, is the same, tired mantra on each and every post no matter what the subject. I don't think the Free Speech Blog was set up to enable one person to address a personal vendetta against another time after time. I don't think anyone wants cg to leave ( if, in fact, he really does ), they are just tired of the same old rhetoric.

I'm sorry that anyone would decide to stop posting legitimate commentary on this blog but that is a right each of us has, but to announce you are leaving the blog because it is not a free speech zone is about as disingenuous as you can get. No one has been attacked more than me on this blog, to date no one has presented any legitimate evidence that I have not written the truth. By legitimate evidence I mean something more than personal feelings, rumors, gossip and personal animosity. Here's the thing some fail to realize, with free speech comes responsibility. I have used my name from the beginning when I post and that has been very costly in many ways but it has not prevented me from expressing my convictions. I feel sorry for anyone who's convictions are so weak that they discard them at the slightest conflict. To stop posting is a matter of choice but to claim an overwhelming fear of some unknown person is nothing short of cowardice. I would suggest that if you really feel strongly about a matter then man up and take responsibility, there is nothing to fear from those who threaten to expose you if you step forward and identify yourself.

I would ask the person that made this statement,

If I censor, you complain that the blog is not a free speech zone, if I address the issue you complain that I am arrogantly trying to control content, if I delete an inappropriate post you complain that I only did it because it was critical of me. I have never deleted a post simply because it was critical of me although I have had numerous people tell me that I should.

If you choose to no longer post fine but at least man up and accept that it is because of you and your fears not because the blog would not allow you to post.

I would hope the person who knows your identity does reveal who you are. In the past you have said some very cruel things to people, especially assuming those who get involved in an issue are "not from here" and you have on several occassions told them to leave their Giles county home if "they don't like it here". That alone, is reason enough to reveal who you are. And, if the poster who claims to know you states, you are well known in the community. If that is so, all the more reason everyone knows who you are. After all, you are a detrement to this county growing with your nasty remarks.

10:58 Agree. After the posts CG has made against innocent people over the years I would hope the poster who has a good idea who CJ is would go ahead and tell us the name. I think even though we might be surprised I also think the people who have been targeted by CG are of better character than CG would have us believe, and they wouldn't approach CG. Still would be nice to know who he/she is. At least we can ignore he/she and know the true character. The poster who has the knowledge could make the statement in the form of a question. That works.

I realize he's probably not going to change the tone of his posts, but I did agree to give him the weekend to consider it. I don't want to tell his name but it looks like his mental defects won't allow him to post like an adult. I certainly hope it doesn't cause his family any trouble as they can't help that they are related to him, though I couldn't care less what problems it causes him directly. If someone tracks him down to extract their revenge, it's nothing more than he deserves. It's on your head, constant griper. Make your choice and make it quickly.

It won't be a matter of backing down. I gave cg my word I wouldn't post his name if he stops hijacking every topic on here. It really is up to him. I'm sure we all welcome his input, just not his whining about Barrett this and lost the election that. I don't see where rhetoric like that is helping anyone.
