Is It Legal, Is It Ethical, Is It Reasonable?
The EDC/IDB because of some very questionable decisions and actions are named in a multi-million dollar lawsuit. Of course the city and county taxpayers are the ones who will ultimately pay the price for some of these very arrogant decisions. You can read about that in the following post.
The question is with the EDC, the IDB, the city and eventually the county all having separate attorneys who is paying the very high attorney fees? Well it seems at least for the IDC a very unique way of finding the money for such expenses has been found without alerting the public or even the County Legislative Body to the fact.
Here's a very nice scenario a local banker representing the IDB loans money to that group. Property is sold but instead of the money being used to pay off the asset that was sold it is actually used to pay attorney fees leaving the county and city taxpayer to continue paying the mortgage on the sold property. Wow, that's like selling your house and instead of paying the mortgage holder you take all the money and buy a new car and expensive vacation then tell the mortgage holder that you're filing bankruptcy. Basically you take the money intended for one thing and spend it on another then let someone else pay. That certainly seems to be the way IDC has chosen to operate.
According to the minutes of a City Work Session dated 20
May 2013 with Aldermen Jeff Hatfield, Charles Jenkins, James Gentry, Pat Miles
present along with City Attorney Andy Hoover, City Administrator Terry Harrison
and Mayor Pat Ford.
This statement appears in those minutes;
“Mayor Ford has
spoken with Mark Hayes, IDB Rep, regarding the use of money from the sale of
land from Integrity. This money is being used to pay for attorney fees relative
to litigations with Wilson Stevenson. Mr. Hayes was advised by the banks to
bring this to the City’s attention.”
If this is not one of the most underhanded tricks played on the taxpayer it certainly is high on the list.
While I don't expect anything other than the usual blank stare and curled lip from the County Executive I do expect more from the County Legislative Body.
My question is when will they act (certainly some have tried to stop this kind of madness but have met nothing but the frustration of stonewalls) and put a stop to this madness.

Just read the minutes from the work session and tell me why the money meant for the mortgage was used for attorney fees? It's like the person who spends their money on cigarettes and whiskey then asks for help to pay their rent. They know asking for help to buy cigarettes and whiskey won't get you very far but asking for help to you pay your rent is a lot more productive. Asking for more money to pay attorney fees for really bad decisions and telling how much was being spent on attorneys would not set well with most people.
I thought any time a bank holds the note on property it is in the contract the total amount owed is due immediately if the property transfers ownership.

The property was sold deed changed to new owner but the money that was owed to the bank was not paid. They sought the cover of approval from the city councel. I checked at city hall and no one will talk about it.

Here's a very simple question. If the bank, any bank, held the mortgage on your house and you sold that house and spent the money without paying the bank, how long do you think it would be before you were being taken to jail?
There is no where or way that I know of that you can legally and ethically sell an asset you don't own without paying off the one who does own it.

I am definitely NOT an Allen Barrett supporter at all, but in this case as I read about it and listen to "people on the street" talk, Barrett is 100% correct. I hate to admit it but I am. Mark Hayes is absolutely in the wrong in this case and FNB should release him from his job or hold him totally responsible. The money should have been used to pay off the debt of the spec building only. Why isn't something legal being done about this. It is going to cost the City of Pulaski a tremendous amount of money just because Mark Hayes pulled a bad deal.

I must be missing something. WAB (What A Buffoon) says the county commission, a body he desperately sued to be a part of, was wrong to make a deal with several local banks to defer one principal payment on a loan secured by multiple pieces of property in order to avoid having to turn to the general fund (that is, us taxpayers) to fund the IDB. So, I presume Commissioner Barrett (there are two terms that will never appear again in print) would have either raised taxes or left the IDB to fare no better than he has in his many lawsuits. And that is leadership?

Looks like 10:20 missed everything last night. The County Commission has known nothing of this under the table deal even the county executive has said she knew nothing about it. It was the city council that was told in a work session not an official voting meeting. It's not one payment but several and it was done to keep from going to the county commission who are already complaining about the excessive amount being spent by Speer and his flunky Rackley.

So if the bank examiners came and saw that the bank was making loans on property then allowing that property to be sold so that the bank no longer had control of that property just allowed payments to continue to be made they would accept that? Who is carrying insurance on that property if the one whose name is on the deed is no longer the custodian of that property? How does the new owner manage financing on such property if they can not produce a clear deed? Would you build a house on a piece of land you did not own? You do understand that any immovable structures on land becomes the property of that land owner? This deal stinks from one end to the other and it is the scent of Mr. Speer and those who control the EDB/IDC.

according to rules governing the edc and idb, do they have a right to seek financing of legal fees outside their budget without the approval of the County Commission, while leaving the tax payers obligated to a mortgage/legal bill with no equity in return, only debt.
And as you say the only ones who profit from this are ones like the bank who profits through interest, late fees, refinancing charges, if applicable, etc., all at the risk of the tax payer. How can this not be a conflict of interest for the bank representative who also sits on the boards that the legal fees are for the defense of their alleged actions? This is only a win for the bank and definitely not the tax payer.
I would like to see Barrett's questions addressed as well.

I would never use the Bible to justify any behavior only to reflect it's words in defining behavior. If you don't think Jesus and the Apostles caused trouble and stirred up things you haven't read the Bible and seen the actions of Jesus when he cleaned out the money changers. Did you read the part where John the Baptizer called out the king, you don't think that stirred up things the way calling out politicians does or is that limited to just calling out the president? I suppose they only beat Jesus and Paul out of pacifism. I never claimed Barrett was an Apostle but I accept that like everyone who follows Jesus teachings he is a Disciple, you do understand what a Disciple is, and yes there are some who are more faithful than others but without having your ability to know a person's heart I'll leave it to God to determine who is who in His kingdom. I suggest that you do a little studying of the Bible, you could start with learning what the words mean, and seeing that those in charge were the very ones who were stirred up by Jesus and then they used the uninformed, low intelligent crowds to do their dirty work of screaming Crucify Him.
