Pseudoephedrine Ordinance Passes City Council


The Pulaski Board of Mayor and Aldermen have decided to make the sale of pseudoephedrine available by prescription only.  They have made an amendment to restrict the sale of pseudoephedrine in both pill and liquid gel form. 
Before becoming law, a public hearing must be held.  I believe that public meeting is scheduled for 13 November but I am not completely certain of that date.
While I strongly oppose the making and sell of Meth or any other drug I have to ask where did the City Council come up with the legal authority to interfere with the sale of legally available drugs?  Why, instead of making it harder on the illegal drug dealers have they decided to make it harder and more expensive on the average law abiding citizen?   

Has there been an opinion from the state that conflicts with other opinions delivered from the same office that states such an act is not within the jurisdiction of the city authority? Has the city now become so influential that they can direct interstate commerce, decide which medical products can compete on the open market , can the city really afford another senseless lawsuit, do we really think a large drug company that stands to lose millions of dollars if this becomes acceptable will not fight it?

I fully agree that meth labs must be stopped but at what cost. Should the freedoms of honest citizens be sacrificed for criminals who will continue to do as they please. Making it hard for an elderly person to get some cold medicine will not have any adverse effect on the criminal any more that making it harder for a citizen to buy a firearm prevents the criminal from get theirs. With the new health care where deductibles will be higher going to the doctor for a prescription will only cost the good citizen. Want to stop meth labs stop playing pitty pat with the criminals that are buying it, selling it and making it by imposing very harsh penalties that make it less profitable.

How tough can it be???? If you go to the doctor once a year which everyone should, simply ask for a prescription for sudafed.

Saving one child from being burned by a meth lab seems a high return for such a low cost.

Some people don't go to the doctor once a year, just when they are real sick. What doctor will give sudafed to a person that don't have any sign of a cold?
What about stores out in the country do they sell sudafed?

I'm sorry about this, but this meth fed business needs to stop.

This is taken word for word exactly as written from the amendment passed by the Pulaski City Council prohibiting the sale of non- prescription medications containing ephedrine products.
“Sell. To knowingly furnish, give away, exchange, transfer, deliver, surrender or supply, whether for monetary gain or not.
Package. Any number of pills, tablets, capsules, caplets or individual units of a substance held within a container intended for sale.
(b) Restrictions on Public Access to Ephedrine Products.
It shall be illegal to sell, deliver, or distribute ephedrine, pseudoephedrine, their salts,
their optical isomers or salts of their optical isomers, without a valid prescription from a
physician or other healthcare professional licensed by the State of Tennessee to write
prescriptions and filled by a Tennessee-licensed pharmacist.”
As you read this consider that even if you are given a prescription for Sudafed and you happen to give two of the pills to your spouse that you have violated the law and are subject to be charged with two counts of trafficking in illegal drugs.
Also consider that even with this new “law” it will not have any effect on the sale of ephedrine in the county.
Stop the manufacture, distribution and use of Meth but at least do it legally, reasonably and effectively.

Why aren't they watching bad parents. Someone should of already seen the child was in in bad home.

Most times they only get a child out of bad homes when parents are arrested for meth.

We have a lot of children in need of help.

Is there any cold medicine out there that isn't used for meth?

You really think 2:37? The meth can still be cooked here, all the meth makers have to do is drive 15 minutes or less in any direction, get their supply of pseudoephedrine and come back and cook away. The logic in passing this ordinance is absolutely ridiculous. You can not put a band aid on a gaping wound and think you have done anything to stop the bleeding. But apparently they just want to try to push the problem on others in the county.

Congrats Pulaski City Council. You never cease to disappoint.

I believe in the Constitution dumbass and do not want to give up my liberties because some dumbasses in office think they are above the law.

Just because cowards will gladly give theirs and everyone elses liberty and freedom away because of a small threat by a few criminals does not mean the ones who are not cowards will follow suit. The same ones who have common sense, and do not want their elected officials to excersise power they are not granted by the citizens.

In my opinion the liars, who swore to protect all citizens Constitutional rights and uphold state and local laws but ignore that binding promise are the bigger more immediate, more imminent threat.

We will see if it plays out the way the geniuses up there, that can't remember their oath of office, say it will.

But in my opinion some of the meth cookers were probably cutting into the profits of some of the more connected, higher up drug distribution channels in Pulaski. Can't have no outsider cooking no meth in Giles County. That is for us good ol' boys.

Usually the ones that do things the right way get punished, or have to work a little harder. I have no problem with what the city council did. I am a law-abiding citizen that would gladly get a prescription for this drug as long as it starts to clean up this county.

Most of you posting on this blog make me laugh because you talk out of both sides of your mouth. I guarantee you liked that the city council did this until Barrett posted this letter. Hell, he probably likes the idea himself, but uses this to take a jab at people. Barrett has way too much personal animosity against elected officials to be unbiased and honest with his topics.

How can you claim to be a conservative and a Christian?

Hey genius at 3:01 Show me the law where it says a visitor to a community has to have a local buy their sudafed for them. Show me Alabama law while you are at it. Meth Cooking back on.

If the existing procedure was not working in Pulaski why is the same procedure so full proof in other areas of the county? Are you making statements that the pharmacists in Pulaski were not doing their job? I'm sure they appreciate your shot at them. Maybe all the local pharmacists are crooked in your mind. Maybe didn't fill your thorazine subscription quick enough for your liking. Or maybe you are just one of the many prescription addicts running around here thinking if it is given to you by a doctor then it does not matter if it is abused. Or more than likely you have a good healthcare plan paid for by the tax payers and plan on gettin as much pseudoephedrine as you and your family members can hall in for the meth cookers.

To me it seems like you are about as logical as a meth head so get off the pipe.

Bandaid applied, Band aid ripped off, Council supersedes its police powers, meth cooking back on.

Bottom line is they did not have the authority to enact the ordinance.

What rights are you giving up 4:18? If you follow the law and don't cool meth, you can still get the drug. Prescriptions can be written for a long period of time. I don't really see the problem.

You all complain that we run our county the same as 200 years ago, but a change takes place to make it a better county and you raise hell. Are there any readers of this blog that see a pattern with these people, like Barrett?

I think officials could vote to save kids lives, make the roads safe, find a cure for cancer and hire only teachers that graduate in the top 10% of their college class and these folks would still get their drawers in a wad over it. It is actually really sad.

There must be other cold medicine out there beside sudafed, because I saw cold meds for sale at WalMart today.

In the past I had heard they were going to have to ask the pharmacist for sudafed and it wouldn't be out where anybody could pick it up. Did that never happen in Pulaski?
I learned years ago to got to the doctor, sudafed ran my blood pressure up. So I know nothing about it. Which Obama may stop my going to the doctor.

Wouldn't most people gladly get a prescription for sudafed? That had nothing to do with or not cleaning up this county. It's just not that easy to get a prescription.

Some people don't have insurance and can't go to the doctor for just a cold. Anything the doctor gives me a prescription for I gladly take it. I don't think he would give me one for something that would hurt me. He's not going to give me one if he/she don't see that I need it. I can't call and say, "I've got a cold I need a prescription for sudafed."

Of course they have the right to control the sale of legal products. We do it all the time with alcohol. City's control where you can sell it' when you can sell it ect ... I teach classes to legal law abiding citizens all the time about Meth. Once they are informed with the real facts . 80% of good folks support making sudafed prescription only.

you are wrong about alcohol. the state controls alcohol.

if federal legislation as well as state legislation grants municipalities the same regulatory control as the usda then you probably would not see a post opposing it. My guess. The argument is not about meth but actual powers bestowed by the people to the elected. The fact they are opening tax payers up to litigation.

All those who scream Barrett cost taxpayers money because of litigation should be screaming at the top of your lungs because of the liability we are open to.

I am glad to see 20% have the sense to know that making this product prescription is just a band aid, a short term fix. And I hope the other 80% will come to their senses and see your class for the sensless opinionated dribble it is.

2:55 not for non-prescription drugs that the FDA has approved for sale without prescriptions. Ask yourself if this new law is adopted how will it stop the sale outside the city limits? The city has no power outside the city and there are stores all over the county that can sell the stuff. Making it harder to get cold medicine for older folks won't make it harder for the criminal. Does Pulaski really need more hysteria driving business away from local merchants?

Richland market, Richland trace market, Campbellsville store, stores in Lynnyville, Elkton, Ardmore, to name a few. Any store that chooses to ark sudafed can do so outside the city limits that’a also in addition to each county bordering on Giles.

If they do not sell "Sudafed" it's only because they choose not to, not because they are legally restrained. While I deplore the use of any illegal drug I abhore the violations being imposed against our Constitutional rights, civil liberties and plain ole simple freedoms even more. When the many are punished for the deeds of a few by an undisciplined government then everyone suffers the tyranny.

If that is true why is on the shelf away from the pharmacy in WalMart?
It's on the shelf same as aspirins in WalMart stores.

I'm all for you having to ask a Pharmacist to get the Sudafed for you, even showing ID to get it, but having to go to the doctor for a prescription is wrong. Why can't the Pharmacy keep it under the counter so you can't just get it.

12:52 There is NO place in Giles County that will sell sudafed now without a prescription. Want to buy it in Lawrenceburg? Try doing that without a Lawrence County drivers license and let me know how it works out for you.

Since when can the counsel decide these issues? A vote is allowed on the sale of alcohol. Why not allow this to be voted on? I can see why some people agree with this law, but the meth cooks will still find ways around the law. They are not moving.
The counsel is pissing on the Constitution! What do you expect from a group of high-balling liberals.
