So, Where Is The Crime????

There are only two ways to see my dad's old van, without trespassing on private property. Here's the view from Northside Drive:

And here's the view from Columbia Highway:

Anyone -- like, say, Officer Bue -- who gets any closer to the van than these two camera positions, can only do so by trespassing on private property. Assume for the moment that you are stupid enough to consider "flat tires on a vehicle parked in a private driveway" to be some sort of crime. Would anyone go so far as saying that this "law" should be enforced, even when it means that, in order to detect the "crime," a police officer must trespass on private property? Unlikely.

Speerites like to call this harrassment -- which, "coincidentally" began a few days after I gave Allen Barrett a couple thousand business cards to spread around, in order to promote this blog -- a "Quality of Life" law. But whose quality of life has been enhanced??? Not mine-- I've got to pay a fine of over a hundred bucks. And not my neighbors, since none of them ever filed a complaint with the police. Surely not the folks who buzz by on Columbia Highway, blissfully unaware that a heinous "crime" is being committed right under their very noses.

I don't think ANYONE'S "quality of life" has been enhanced by the mindless enforcement of this purported law. This whole ludicrous enterprise has been pure and simple harrassment, most likely aimed at "punishing" me for allowing the "little people" to anonymously express their opinions on this blog.

On the other hand, if it's been something other than spiteful harrassment, it is probably time that officer candidates at PPD receive CAT scans of their head, before receiving their tin badges. I'm pretty sure that no-one with more than half a brain, would stoop to enforcing a law as utterly ridiculous as the one I'm accused of breaking!

Mr. MCPETERS,

I CANNOT SEE HOW YOUR PROPERTY IS IN ANY WAY VIOLATING ANYONE'S QUALITY OF LIFE.

IF THERE WAS NO COMPLAINTS TO THE POLICE DEPT. BY YOUR NEIGHBORS..WHO EXACTLY HAD A PROBLEM WITH YOUR VANS FLAT TIRES. NOT SAYING THIS IS THE CASE WITH YOU...BUT NOT EVERYONE HAS THE MONEY TO GO AND BUY A SET OF TIRES BECAUSE DAN SPEER AND THE ELITE CAN AFFORD THEM AND PROBABLY WOULDN'T HAVE TO SAVE FOR THE EXPENSE.

I AM SO SORRY THAT YOU HAVE BEEN TREATED THIS WAY...TO ME THIS IS JUST DOWN RIGHT HARRASSMENT.

Looks like it is time to borrow a floor-jack and get 4 pieces of wood about 12" dia and 18" long and simply jack it up so those highly offensive tahrs are not even touching the driveway then none of the lookenpeepen polizei and secret operatives wont even know it's airborne . It'll just be like the other 24,000 abandoned vehicles in Giles Co. .
Or you could invite a family of squirrels to inhabit it , at which point it surely becomes a residence and so not subject to this loony law .

This is total BS! Quality of life is a medical term such as a situation where a person is so ill it is impossible to improve their "quality of life".

Whomever the vicitm is in this case needs to research what kind of law there is on the books about a parked vehicle on private property having flat tires.

Me either.

IF THERE WAS NO COMPLAINTS TO THE POLICE DEPT. BY YOUR NEIGHBORS..WHO EXACTLY HAD A PROBLEM WITH YOUR VANS FLAT TIRES.

That would be officer Chris Bue of the PPD. His elevated sense of aesthetics was so highly offended by those flat tires, that he threatened to use violence against me, in order to make me sign the citation. (So, I signed it with the notation "signed under duress," which Judge Hayes acknowledged but refused to give any legal weight.)

NOT SAYING THIS IS THE CASE WITH YOU...BUT NOT EVERYONE HAS THE MONEY TO GO AND BUY A SET OF TIRES BECAUSE DAN SPEER AND THE ELITE CAN AFFORD THEM AND PROBABLY WOULDN'T HAVE TO SAVE FOR THE EXPENSE.

You're exactly right. This whole fiasco won't be over when I pay the fine and court costs. No... I'm going to have to pay to have the vehicle towed to a place (outside the city limits) where a friend will restore it to "operability." That means four new tires, a new battery, and labor for tuning up the engine. All of this money, simply because a busybody with a badge wouldn't listen to reason. It's absurd!

I AM SO SORRY THAT YOU HAVE BEEN TREATED THIS WAY...TO ME THIS IS JUST DOWN RIGHT HARRASSMENT.

Agreed. And the timing is very suspicious, to say the least. To anyone who feels that this was unwarranted harrassment, I have but one suggestion: vote in someone new to replace Damn Speer as mayor.

How do you know that no one complained about your vehicle?

Because Chris Bue said -- in open court while under oath -- that nobody had complained. He claimed that he and he alone had noticed the "violation" -- his eagle eyed vision had noticed, from a hundred feet or so away, that the tag was expired, and this gave him the pretext to invade private property, inspect the van, and discover the unGodly horror of flat tires, which compelled him, as a LAW ENFORCEMENT OFFICER, to take action against Pulaski's Public Enemy Number One, the evil lawbreaker Kendrick McPeters.

And how deep do you want to go with this discussion?

Only deep enough that I get an apology from the tax fed parasites Bue and Hoover... not that I'll be holding my breath waiting on one.

This topic really seems like sour grapes to me!

If you were out several hundreds of dollars because Dan Speer passed a stupid law -- which is hardly enforced anywhere in Pulaski -- and a rookie robo-cop insisted on hauling you to court over it... you might feel a little differently.

At any rate, I was content to stew about this in silence, till some jerk -- apparently a local cop with a Ph'D from Vanderbilt... riiiiiight -- brought it up on this blog in an effort to belittle me. So, I really didn't have much choice in the matter, you see.

As to why I created a new topic, that is quite simple: it was the only way I knew to post those ever so damning pictures, on this blog. A picture is worth a thousand words, and anyone who looks at those two pictures can easily see the pettiness and stupidity of the harrassment I've had to put up with these past couple of months.

I'm not accused of having a "junk car." I'm accused of having a van with flat tires, which makes it "inoperable," and thus, illegal. However, none of my neighbors ever complained about it, and TO EVEN SEE THAT THE TIRES ARE FLAT REQUIRES TRESPASSING ONTO PRIVATE PROPERTY.

Don't you think new industries would prefer to locate in neater places?

No, not necessarily. An unhealthy obsession with "neatness" and "law enforcement" would be considered an "unfriendly business climate" by most industries.

Mr. McPeters, I was wondering where you worked at. I have been told that you are not employed.

I spent eleven years of my life providing full time care for my invalid mother. (I also did the bookkeeping for her business, Pulaski Refrigeration and Electric Service.)

During that time, I spent many of my spare moments trying to come up with ways to make money, while still living in Pulaski and taking care of my mother. I put a lot of time and research into this matter, and eventually succeeded in coming up with several plausible ways to earn a living out of the home.

Alas, my mother was extremely conservative when it came to finances, and she wouldn't give me the money I needed to spend on, for example, patent lawyers. But I loved my mother and stayed with her, and I kept her out of the nursing home, just like I promised my father on his deathbed. And eventually -- on August 16th of last year -- she died. I now stand to inherit 1/3 of her estate... which should be, if I'm lucky, enough to start up two business ventures: an electronic newspaper, and a franchisable system for building homes from poured concrete, with greatly reduced labor costs as compared to present methods of construction.

You sit at home and draw a disability check

No... I do NOT!!! That is a contemptable lie, as you probably are well aware. I do not receive any sort of welfare check, and I would not accept one, even if I qualified for one, which I do not.

I am 100% opposed to any form of government provided "charity" and I practice what I preach. If I should ever fall on hard times, and friends and family are unwilling or unable to help me out, I will live under a bridge in a cardboard box, diving into dumpsters for food, before I would throw away all of my principles, and accept a penny from the den of liars and thieves which calls itself "our government."

because you are extremely over weight.

I am well above my ideal weight, that is true. But considering that I spent two decades severely depressed, and found, during that time, that nothing could take away my emotional pains other than eating, it is miraculous that I'm not twice my current size.

Of course, I eventually converted from Atheism to Christianity, and, in the process, got over my depression. So why didn't I go and lose all my excess weight, at that time? Well, to be honest about matters, there is one thing to be said for being fat, at least in my family: it gives you an easier exit from this world.

My father had three brothers and two sisters. He -- perhaps because he was fat for most of his life -- died painlessly from a heart attack. But all of his thin siblings -- other than a sister who died in childbirth -- died miserable, excruciating deaths from cancer. I think my father got the best deal in the bunch, and, having seen so many people die in my family from cancer, I know for sure that I'd rather die from a heart attack.

Then there is also the matter of my glaucoma. If I'm alive twenty years from now, I'll probably be totally blind, and completely dependant on care provided by other people. This is not a situation that I'm keen to live to endure. Honestly, would you?

I may yet decide to lose weight, even at the risk of suffering through cancer and blindness. In fact, I've even taken the first step down that road--- I've switched from drinking 2 or 3 litres of Sundrop per day, to drinking 6 cans of "Tropicana Sugar Free Lemonade" per day. That Tropicana Lemonade is the BEST TASTING diet drink I've ever found, and, while I miss the flavor, fizz, and caffiene of dear old Sundrop, I'm glad to be rid of that 1200 calories a day of high fructose corn sweetener. (As an aside... Sundrop used to really taste great back in the old days, when they made it with real sugar! That corn syrup crap is only used because the idiots who "govern" us subsidize the corn syrup industry with billions of dollars of stolen tax loot, every year. Everyone else in the world gets to drink sodapop sweetened with pure cane sugar... but not us, since the well being of the ADM company trumps any other concerns!)

Is that true, or just a conspiracy to harass Pulaski's number one public enemy.

I rather doubt that there is a conspiracy..., but the allegation that I'm suckling Uncle Sam's welfare teat is a vile, black hearted lie.

You wished you were that important.

It looks like you are irony impaired. I've been calling myself "public enemy number one" to highlight the extreme idiocy of wasting so much police time and taxpayer money prosecuting me over a "crime" that had no victim, and no complainant. Obviously, unless Pulaski has been turned into a crime free utopia -- and last time I checked, it has not -- there are many more important "fish" to "fry" than myself. It is an outrage, and an obscene waste of tax dollars, to harrass me over FLAT TIRES when there are still murderers, robbers, and rapists running free.

The truth is most people don't have a clue who you are and don't care.

I'm sure you are right. But Chris Bue, the Robo-cop who harrassed me without mercy -- reports to Dan Speer, and I'd bet dollars to donuts that Dan Speer knows me.

Of course, I'm sure it's just a "coincidence" that officer Bue showed up at my door, four or five days after WAB began putting business cards (advertising this blog) on car windshields all over town. Coincidences like that really do happen... right?

yeah they got me one time several years back for parking a car with expired tags in my backyard.
Luckily i was able to pull it in my driveway & nothing more was said about it. (I backed it in with the tag no way showing also was told that as long as it was in the driveway it was okay)...
Now why is it that all over town & especially in the "projects" & Washington Heights & Spofford Street there are junk cars sitting on the street, in parking spaces & up on blocks that have rusted out,
have oil stains under them & i know for a fact have not been moved since the people moved there,
and not one of them have ever been ticketed or removed in the past 10 years????
Are we now going to see all these cars moved or ticketed??
i'm going to take cell phone pics of everyone i see & know of & watch how long it takes for them to take action since this is a blight on the neighborhoods they are parked in.
If something is not done to all these other cars then i would think that would be like 2+2 would it not?
If we are going to clean up lets clean up all the junk especially right here in the city.
Right is Right.
I will attempt to forward those pics to this blog as soon as i can figure it out on my own...
Let's see how diligent our local protect & serve really are

GET A LAWYER!!!

Friday, February 15, 2008 12:42:00 AM
Blogger J. Kendrick McPeters said...

Well, this thread has been up for a while, and so far, no-one has looked at those two pictures, and seen a crime in progress. This confirms my reasoning for taking the matter to court, rather than capitulating and paying the fine...

That is, I believed that, if I received a trial by jury, it would be a certainty that at least one juror would, after seeing those pictures, refuse to convict. But why would I expect a jury trial? Well, Chris Bue threatened to have me physically hauled off to the jail -- I would not have cooperated by walking -- if I refused to sign his citation. If I could be JAILED over flat tires, then it sure sounds like a criminal case, and thus a jury trial is guaranteed by the Constitution. On the other hand, given that the fine was greater than $20.00, I should've had a right to a jury trial, even if it was a violation of civil rather than criminal law.

Alas, Judge Hayes refused to grant me a jury trial, and then, in the "bench trial" that followed, he closed his ears to all of my arguments, pretending that he had no right, as a "judge" to "judge" the merits of the law. There never was any question that I "broke" the "law," so Judge Hayes' trial was rather in line with the sort of "justice" that dissidents received in the late, unlamented Soviet Union.

Say what you will about soldiers storming the beach... the people who really gave us freedom, are people who stood up to bad laws. From John Peter Zenger in 1735, to the civil rights activists of the 1960's, practically all of our freedoms can be traced back to a handful of people who refused to obey laws which they regarded as immoral. Alas, tyranny now is almost completely free to flourish, thanks to the evisceration of the traditional jury system. Once upon a time, jurors were expected to judge the morality of the law, as well as the "facts of the case," but no more. Now, simply mentioning "nullification" in a courtroom, will get you thrown in a prison cell for "contempt."

That being the case, the chances that we will live to see a restoration of freedom, are indeed quite slim. However, while me may be utterly helpless, in the face of the tyranny of the federal leviathan, and that of the State of Tennessee... we do still have some bit of control left over the government of Giles County and Pulaski. There may only be a remnant of freedom left, but it is worth fighting for, and it is for that reason that I keep this blog running. Because, without knowledge of what "the powers that be" are up to, we can completely forget about making any sort of positive change...

Here's a quick question for those of you who are defending, however anonymously, the harassment I've received:

What moral difference, if any, is there between what was actually done to me, and having Officer Chris Bue simply stick a gun in my face, and threaten to blow my head off, if I don't give him a hundred bucks?

Can someone please explain to me the difference? Many thanks in advance!

altho he was involved in criminal
activity at the time he was shot he was laying down with his current girlfriend in a sleeping bag UNARMED & was shot "in self denfense" as they said he was going for a gun he had hidden.
Of course there was a gun "found" there with him after he was shot & killed. Giles Co. got tired of him & his criminal ways so they got rid of him by using the TBI to shoot him on sight as he was a "fleeing felon".
Can't be proved but some of us know the what went down that day.

You seem to be sure of your facts and occurrances of that day. The only way someone could be that sure is to have been there when it all went down. If that is so, then why have you waited this long to speak out. Since 1961, all police shooting have been investigated by a higher ranking agency. Therefore if a TBI agent shot this man for no reason, then the FBI had to investigate it. What was your part during the investigation, or did you with to remain silent until this blog was born. If you were not there, and you were not the investigating officer, then all your information is second-hand and hear-say. From my stand point, it appears you only obtained information from the victim's (criminal) side of view.

How utterly ridiculous to accuse me of hatred for people I don't know. I do despise the way they treat people who disagree with them, and that has ALWAYS been my bone of contention with them. How many times does that have to be explained? By the way, I was taught not to hate people but to perhaps hate their actions when they prove to be reprehensible.
You talk about these "nice" people who go about calling people names and attempting to embarrass and even ruin them. Well, there is an old saying that goes something like this: a person who is nice to you and rude to the waiter is NOT a nice person. No, nice people do not get on a public forum and call people crooks, liars, idiots, ignorant, etc.
I'll not waste time talking about the encounter group. You guys know who they are. Just ask around town.
As for those who are trying to clean up this "mess" in Giles County, I see that there are but two options. If there is a question of breaking the law, let the police handle it. If there's a problem of dislike for elected officials, let the voting booth take care of that.

You think I am someone in city or county government? And you call me delusional? Laughable.

Kendrick,

I am so sorry this has happen to you.

I know in other towns if the car don't run you will be fined. I have a friend in Fordia that pays for tags and insurance so her deceased husbands' car can set on her car porch. I thought she was crazy, I don't have that kind of money to throw away.

I've seen your father's van behind your house and don't see why it should bother anyone. In my passing I didn't know if it was moved from time to time or not.
Can't tell the tires are flat from the road.

Your van doesn't look lots of other yard cars I've seen, no grass growing up around it.

It is very frightening when government or government official can use the power of government to intimidate and harm a citizen, just to show they can do it. Fourth Amendment like all the rest mean nothing - sure sign of tyranny.

I think the new chief should talk to his officers starting with Bue. Since I've read this I've seen MANY vehicles with flat tires and junked all around town. And they were sitting much closer to the street. Bue would not have to strain to see those. Wonder if they have been ticketed?

Looks like the greater crime is to be found in the condition of the road leading up to the driveway.
