Former Director of Schools Dr. Timothy Webb has rescinded his letter of resignation to the Giles County School Board.
The move was confirmed to WKSR after yesterday’s school board meeting. Board Chair Mike Young said he received a text message from Webb July 3 stating he was rescinding his resignation. When asked if he expected the move, Young replied, “no.” School board members met with their attorney in a private executive session prior to last night’s meeting about contract issues and Young confirmed the discussion involved Webb. The school board is currently paying two directors: Webb and Interim Director of Schools J.B. Smith
This is a classic case of doing the right thing but doing it the wrong way at every possible opportunity.
Last night with an attorney sitting there and School Board Member Greene asking directly of him, "are we doing anything illegal or that can be used against us in a legal action" the attorney twice assured them that there was nothing wrong with what they were doing all the time knowing they were paying two directors of schools. Knowing they had hired an interim director without accepting the resignation of the former director. Has the resignation of the former director ever been officially accepted, it absolutely was not accepted by a vote in an open school board meeting.
This whole thing has been one huge cluster flub from the beginning and only gets more messy with each new decision. Why is the School Board continuing to pay Dr. Webb? Why are they continuing to rely on attorneys who have led them down this road of disaster with bad advice? When will the Board rely on common sense in making their decisions or failure to make those decisions?
I for one am fed up with the secrecy and ineptness and stupidly illegal behavior.
Based on what I know Dr. Webb did the right thing by resigning but the School Board and its attorney should all be fired for their total incompetency in handling this matter. They have not only created a major financial burden, a legal nightmare they have embarrassed the entire county.

My question is, why did they not make accepting his resignation the first matter of business at the special called board meeting so this exact situation couldn't happen? Incompetence at its finest. Another messy school year lies ahead.
The school board did what the attorney advised them. You cannot blame the school board for not knowing what is legal.
If a person gives you a resignation accept the resignation before filling the position. That's common sense. Who hired the attorney in the first place?

This is what happens when you have inept people running things who are elected not based on their qualifications, but on what church they attend or who their "momma nem" are. Also, it happens when there is no journalism in a community or when the media is bought and paid for by those in charge. We have reaped what we've sown Giles County.
When the producers are needing a new script for a "Dumb and Dumber " movie (or is it "Dumber and Dumbest " ?) they wont need to hire a script writer . Giles Co School board have already written it for them .

Someone made a remark about Minor Hill's board member a few weeks ago. Looks like she was the smartest. She asked if they didn't need to vote on excepting Webb's resignation.

Chuck Cagle was the attorney who stated it was not necessary to vote to accept the director's resignation. Kudos to Ms. Glover to have the foresight to ask in the first place. I say the attorney is guilty of malpractice. Let him buy Webb off. Shouldn't have taken a great legal mind to answer a common sense question.
But the board should have had the common sense to accept the resignation before filling the position. That should have been automatic and no need to consult an attorney. Nothing could be achieved by not accepting it. Wouldn't any reasonable person arrive at the conclusion that if a resignation is turned in and it is not accepted then the contract which Webb is under is still in full force.
But I would like to see proof of the accusations made against the Webb. I've seen how some people will lie for the sole purpose to hurt another they do not agree with.
there is only one director, that is smith even though they are paying two. its just a plot by webb to get paid even after he quit. why not he got paid all year for not showing up for work.
all the talk about the board accepting the resignation is nonsense. think of it this way. if you resigned and quit your job and your boss..or bosses.. said no we have not 'officially' accepted your resignation so you are required to keep working until we say so, could they force you to keep working. no. once you quit, you quit period. unless its the military but that is another story.
its over and done and webb is no longer director. this is just to get paid. the question i have is why was this not brought up at the board meeting, especailly if young knew about it since july 3 like wksr told. and if webb was really serious about it would he have really 'unresigned' with a text. thats not very official now is it.
All of this could have been avoided if Bryant hadn't decided to be the lone ranger and act on the word of a person who felt wronged by Webb, and had in fact been spying on him for others. Also, if Bryant had done the right and legal thing, he wouldn't have broken the Sunshine Law, would have brought it to the Board, and they could have done a formal investigation into the allegations and address the issue with Webb. Talk about lack of common sense! And Greene? Asking for his resignation in the previous meeting after the board gave him a 3.9 rating on his evaluation? What did Greene THINK he knew? Did he get information even before Bryant? And it was clear the only board members who didn't know anything about any of it at that first meeting were Glover, Young, Storey, Bryant (at the first meeting) and Turner (who was probably to busy trying to hunt down and shoot one of her relatives). Common sense would call for due process to find out whether the allegations are true, or whether they're in fact as it seems, the spiteful, vindictive product of a pathetic, backstabbing witch.

If you are under contract and decide to turn in your resignation, you are still employed under that contract until your resignation is accepted by the appropriate body. Dependent upon the contract the board could have forced Webb to perform under the contract or be in breach. Sorry you do not understand that. Are you a school board member?
His text is as official as an email. Since his resignation was not accepted he had every to withdrawal his resignation and stay in that position.
The voters should elect 4 new board members in August to replace these idiots. Turner should resign.
Let's hope the County Commission makes a good choice when it selects the new board member on July 21.
The Board is currently in a dead period under the law and cannot act until 30 days after the election. This means they cannot vote to accept his resignation. They could have on the night Glover asked the question, but now the 45 days before the election time is running and their hands are tied.
Since Webb has rescinded, I guess the new elected body will get to decide if he stays or goes. What fun for them since they did not cause this mess.
If the Board and it's attorney are so positive this is all legal and his resignation is official then why are they not putting it on the paperwork to show it is final. I have heard it from someone who has seen the paperwork that Dr. Webb's name is not on the list of retiree's, resignations's, terminations, and new hires. Of course this is all board approved each month - its called the personnel report - One would think this would have clued them in to the fact they needed to accept his resignation since they accept all their other employees....and if this is the paperwork used to delete folks from the payroll then why would he not keep getting paid??
Having an employment contract is a lot different than applying for employment and getting hired without one. A signed legally binding contract sets out the terms of how things are supposed to be done and what actions each party are to follow. If his contract states his resignations must be accepted by the board then that has to happen.
Lets hope WEBB sues the Board members individually. Actions outside of official duties are not covered by insurance and not the problem of the Giles County citizens.
Those accusing him of drunken behavior better hope they can prove this allegation. But how can they. Saying someone is stumbling around, sleeping, slurring their words is not proving he is drunk at work. This is called defamation of character and hiding behind dedacted accusations will not save you.

Was Webb not working under a 1 year contract? Would that not have ended now? If the board does not renew it, it should be over. Friday 11:08, were 80 pages turned in by 1 person? If Bryant acted alone he was not breaking a sunshine law. I am glad that somebody finally had the courage to step forward and turn him in.
Accusing some one is not the same as them committing the act. Look at the Chili Cook off and the false report filed by Vicky and Terry Harwell. Their accusations, although spread around town, were proven to hold no truth.
The paper stated the only thing contained open records request were accusations and no proof of the accusations.
I would like to see proof of the accusations and hope it is not another instance like the Harwells filing the false report.

The person doing the "surveillance" surely broke the law by taking Webb's cell phone and allegedly taking pictures of some texts?! If she had that access, could she not have typed thse texts herself? Don Storey stated in his speech at the meeting to name JB Smith, that this person had had this harmless information for MONTHS, but didn't choose to bring it to Jerry Bryant until the day she was denied a raise by Dr. Webb.
Bryant then took HIS WIFE with him to DEMAND Dr. Webb's resignation. Now Jerry Bryant says he and HIS WIFE didn't have anything. I would imagine that some confidentiality law was broken by bringing his wife into Dr. Webb's office. He brought his wife with him apparently to vindicate the fact that Dr. Webb didn't hire her for the position she wanted. And same with Rhonda Turner. She didn't get a job from Dr. Webb and so turned on him. At the "Emergency Meeting," where the board did not accept Webb's resignation, it was apparent that Jerry Bryant had told some of the board members but not all, WHICH MEANS THAT THE SUNSHINE LAW HAD TO HAVE BEEN BROKEN. And why did Jim Greene demand his resignation after he received a 3.9 on his evaluation? What did he think he knew, and where did he hear the allegation?
Ironically, I've heard that the texts and the rest of the 80 pages are harmless and do not come close to proving the allegations made against the man. Ever heard of DEFAMATION OF CHARACTER?!
I don't know Dr. Webb, and I don't know the board, but from what I've seen so far of this fiasco, Webb is going to be a rich man if he chooses.

As a person who is not from Giles county but moved here several years ago I can tell you this county is doomed.
This is just another example I have seen of basic incompetence of the elected officials. Unfortunately, the writer above at 1:55 PM is absolutely right, nothing is going to change until the people are voted out and new people are brought and who are not beholding to other people.
What is the possibility of this? I estimate the chances as slim.
Webb is still the Director. I heard that Smith has already hired his wife. How is that for integrity? This entire deal has been a lawsuit waiting to happen. The tramps and morons trying to throw Webb under the bus are going to be completely humiliated, and should be, by the time this is all over.
If you look at Webb's actual evaluation he didn't have a 3.5 it would have been a 1.175. 3.5 and two 0 equals to "do the math". .divide 3.5 by 3. The board has done a crappy job from day 1 with Webb. They did not check out all his credentials but listen to the wrong people. I believe there is more to come on Webb

Two of the evaluations were not done, so are not counted in the average, not that they count as "0." Also, the third one, was half-way done, so no final number. Those people not doing their job (Glover, Turner and Greene) means they are not counted.
If you want to talk about doing the math, you should study how to average a set of numbers.

There are seven board members. I don't care if five weren't done you still have to average in everyone's scores. If two did not fill out their reviews then it will still count as a 0. What if one had only finished with a 5 does that give him a perfect evaluation. There are seven to be averaged in.
It makes sense to me that only the ones that are turned in are averaged.

What about the fact that the director was being paid and never showed up for work? Ask anybody that ever had an appointment with him how many times he cancelled. The only way you could talk to him was to call his cell because he was never in the office. That is reason enough to let him go.

My question about the whole thing is in 80 pages you have accusations but no proof according to the local paper. But none of the names of the people who did the accusing were published. I wonder why? I think these people who did the accusing with no proof should be made public so they may be scrutinized. After all they are the cause of the problem, if you apply the enabler's logic. I have heard from employees of the system that non of the accusations about Webb should be trusted and were the result of a coordinated effort by a group of disgruntled employees that were mad they were having to be accountable in their positions.

Look here's the simple thing about the matter, as far as I know Mrs Coleman jus the only Commissioner that has taken money for attending a meeting that she did not attend and that is fraud. She is the only commissioner I know of that has requested to be on a specific committee then fail to attend over half those meetings even after they were moved to a different date to better accommodate her. She is the only commissioner that spends excessive time in meetings playing with her phones. She has expressed support for a $75.00 wheel tax and property tax increase while stating when asked what the current property tax rate was, that she didn't know. She took bankruptcy but want to control other people's money. These are some of the reason I have criticized her.
Mrs. Vanzant has no respect for the truth or compulsion to speak it preferring instead to tell people what she thinks they want to hear rather than the truth. She has squandered the finances of the county by hiring her friends instead of the best qualified, allowed incompetent people to control the budget and manipulate it. She put Terry Harwell in a county job he was unqualified for in order I suspect to continue his unquestioning support and gain more support from his wife. She totally destroyed the rules for the sell of beer in the county requiring the state to step in and demand better behavior; she plays favorites and is vindictive toward those who offer the slightest questions. She is in a word "incompetent" and with her fraud in paying Mrs Coleman for a meeting she did not attend is a proven thief.
Mr. Harwell acted like a complete fool at the chili cook off, see the video on you tube, lied on an official police report about the incident, unprovoked, except by his wife, physically and verbally attacked a private citizen using such vile words in describing the man that it is legally termed hate speech. Then in an arrogance unknown by most people challenged the man to do something about it since he was a county commissioner. He currently is being paid by the county twice for the same hours each time he attends a committer meeting and brother does he attend meetings going from six committee meetings the year before being hired by Mrs Vanzant to seldom missing one now with double pay. He supports a 75 dollar wheel tax.
Mr. Campbell has been on the commission way too long, he has never met a problem that more money would not fix, but what has he accomplished? He has publicly stated that "we've done things this way for two hundred years why change now" he is a leader to implement a $75.00 wheel tax and a property tax. He has opposed practically every effort to move the county forward even opposing the Exit 14 development. He was a leader in the last huge property tax increase that placed us with the ninth highest property tax rate in the state at the time we are now at number 14. He refuses to return phone calls to constituents or answer questions from the public. He even refuses to appear at any public functions where he might be required to res[pond to the public.
These are a few of the reason I have criticized these specific individuals and will continue to criticize their disrespectful and at time illegal behaviors. I also have put my name on this post as usual so now you can claim that it was actually anonymous who posted it.

Here's what I know about Mrs. Coleman. She is a nice person who has more class about her than to respond to your spewings and venom. To her, I think she sees you as a feisty little dog barking around her ankles...making lots of noise and yet seen as a nuisance. It's pathetic that you can't see this.

The board let TSBA advise them the last three times, Little, Jackson and Webb. Does anybody see a pattern here? Maybe they should use their own judgement and look at the applications themselves this time.
I'm an attorney and just happened to see this. This is a first-year law school issue. Most directors are under contract. If the resignation was in writing, and the letter was sent (even once it is mailed), it counts. If the director is under an employment contract, and he sent the letter, that ends the contract regardless of whether or not the board formally "accepted" the resignation (unless that specification is in the employment contract itself).
However, if the board has taken any actions (even if informal) after the letter was sent, it could be argued that it counts as continued employment, thereby nullifying the resignation and accepting the director's rescindment of said resignation. I'm merely saying it could be argued this way, but it would depend on the facts specific to the case.

Just to clarify, when I mention the board taking "any action," I mean that with regard to actions that can be considered a continuation of employment (i.e. letting the director continue to work, paying him or her, etc.). However, a director wouldn't necessarily be under contract if it was cancelled in writing (the resignation). That's contract law 101. When the letter is sent (even if it was just dropped in the mail a second ago), it counts.
So, I'm curious why no one out here is talking about JB Smith's past issues. Those are far worse than anything Webb, Vanzant, etc. have been accused of committing, and are substantiated.
I noticed that if you call the Central Office you do not have to go through the guard dog secretary to speech to the director. They put you straight through to his line. It is nice to finally have someone at the office that you can actually speak to without talking to the secretary who thought she was the assistant director instead of administrative assistance. She is so dumb she did not realize that Assistant Director is someone who has a degree and knows something about the school system, like assistant director would be a certified position not a secretarial position.

I was wondering how long it would
take for someone to claim racism. The issues to which I refer have NOTHING to do with race. They have to do purely with actions that are either immoral or criminal, depending on which one you choose to discuss. He's been shielded, but I believe it will all come out and people will realize he is far worse than Little, Jackson, Webb, Gonzales, Vanzant, or Coleman.

I have spent my entire career as a secretary even though my title is now administrative assistant. It is the same thing.
You can say what you want to about JB Smith but the bottom line is this. He ran a tip top school. He is well respected. He is a good Father and Husband. He is a good Christian man in Church every Sunday. He put the students and academics first. And now he is trying to make this school system tip top shape. So blow your smoke up someone's butt who cares. Your rumors won't intimidate him, he will go about business as planned.

Why would anyone be walking around town during a festivity of fun with a copy of the city ordinance. Why would that same person walk by several others with open flames and make an issue at the Harwell booth.
